-44- <br />XXIV. Operations on Land <br />t to Limitati <br />The operation is in compliance with the requirements of these sections and <br />Rule 2.07.6(2)(d) for the following reasons: <br />1. The permit area is not within: <br />a. An area designated unsuitable for mining; <br />b. An area under study for designation as unsuitable for <br />surface coal mining; <br />c. On any lands subject to prohibitions or limitations; or, <br />d. Within 300 feet of any occupied building. <br />2. No portion of the permit area, other than the access road <br />intersection with the county road, are within 100 feet of any public <br />road. <br />The operation is in compliance with the requirements of this section. <br />XXV. Demonstration that Surface Coal <br />aerations can <br />Based on the technical literature and reclamation results observed to date at <br />Grassy Gap and at other mining operations in Routt County with similar <br />environmental conditions, the Division finds that mining and reclamation can <br />be feasibly accomplished as detailed in the permit application and this <br />findings document. <br />XXVI. Compatibility with Anticipated Adjacent Operations - Rule 2.07.6(2)(1) <br />The Division is not aware of any operations proposed for areas adjacent to the <br />proposed Grassy Gap permit area. <br />The operation is in compliance with the requirements of this section. <br />XXVII. Reclamation Fees Required <br />t <br />Based on communication with Office of Surface Mining, Fees and Compliance <br />Branch, the Rockcastle Company has paid all reclamation fees as required by 30 <br />CFR, Chapter VII, Subchapter R.
