-33-
The haul road at the mine is in two sections. The first section is an
upgraded BLM right-of-way 4732 feet long; the second is 2768 feet of new
road. The information contained in the application verifies that the
location, design, construction, drainage, surfacing, maintenance, and
reclamation of the roads were planned with the consideration of the design and
performance standards of Rule 4.03.1.
It should be noted that Rule 4.03.1(4) contains specific designs for the
spacing of culverts on haul roads. The applicant is in compliance with the
spacing requirements, with the exception of the first 3300 feet of the haul
road. The Division has granted a variance from the requirements of rule
4.03.1(4)(e)(vi) for this road segment. The decision was based on the
following facts presented in the application:
1. Road grades were low, generally 3-6%.
2. This segment of road does not cross any defined stream channels or
drainages.
3. The watershed above the road is small (50 ac. max..).
The haul roads at the mine have been certified by a reyistered professional
engineer that they have been constructed according to designs contained in the
permit application.
Two types of light-use roads are used at the mine. The first type consists of
pit roads, which change ferquently with the pit configuration. These roads
are of stable configurations and within the sediment control system.
The second type of light-use road is the "perimeter" road. This road was
required by BLM to act as a buffer between the mine and surrounding BLM
roads. The road is used only for periodic monitoring and inspections. The
design, location, drainage, surfacing, construction, and reclamation plans for
these roads are more than adequate to meet the performance standards of 4.03.3.
The operation is in compliance with the requirements of this section.
XXI. Bonding - Rule 2.05.4(2)(b) and Rule 3
Walden Coal Company has agreed to post a performance bond in the amount of
$813,723.00. The Division has determined that this amount will be sufficient
to cover the cost of reclamation at the mine.
Pursuant to rules 2.07.6(2)(j) and 3.02.1(1), the performance bond in this
amount must be filed with the Division, payable to the State of Colorado,
before a permit will be issued, and within five days of the date that the
proposed decision becomes final.
The operation is in compliance with the requirements of this section.
