<br />-34- <br />XXII. Sealing of Drilled Holes and Underground Openings - Rul <br />The Division has reviewed the permit application for compliance with the <br />requirements of this section. Information can be found on page F-12 of the <br />permit application. <br />A11 drill holes, wel]s and underground openings will be appropriately sealed. <br />The operation is in compliance with the requirements of this section. <br />XXIII. Miscellaneous Compliance - Rules 2.05.6(5), 4.U2, 4.12, 4.19, 4.21, <br />4.28 and 4.30 <br />The Division has reviewed applicable sections of the application for <br />compliance (Section 8, Section D and Section E of the application), <br />Two areas of abandoned coal mining were present at the mine site prior to <br />commencement of operations in 1919. Une area was an incline and room <br />approximately 100 feet in extent (the hlc0allum mine), the other a small <br />excavation 20 x 30 feet at the outcrop of the Hoyle seam. Both are of small <br />extent. The Bourg operation mined through the McCallum mine in Stake I <br />operations and was completely backfilled. The small outcrop excavation will <br />be mined through in Stage III of the mining operation and will be completely <br />backfilled. <br />The Division hereby conveys approval to mine through the outcrop mine on the <br />Bourg property. Upon examination, it has been determined by the Division that <br />this does not constitute an underground mine. Therfore, concurrent approval <br />of the mining oy the applicant is not required of MSHA. This has been <br />confirmed by on-site investigations by MSHA. <br />The applicant has proposed coal exploration outside of the permit area, and is <br />in the process of obtaining permits from the U.S. Bureau of Land Management <br />and the Division. <br />The applicant originally submitted a plan within the permit application <br />addressing a proposed rail loadout facility in Northgate, Colorado. After <br />discussion of further baseline and design information required to permit the <br />loadout, the applicant withdrew plans for the loadout. The proposed loadout <br />will be addressed in a technical revision to this permit later. <br />The applicant has adequately addressed the topics of temporary and permanent <br />cessation of operations within the permit document. <br />The operation is in compliance with the requirements of this section. <br />
