_32_ <br />kule x.14.2 specifically requires that all areas affected by surface mining <br />operations shall be returned to their approximate original contour. The <br />applicant proposes to restore the mine site to approximate original contour. <br />The Division has evaluated the relocation of a minor ridge by 200 yards and <br />has determined that the resulting post-mining topography meets the <br />requirements of approximate original contour. <br />The applicant is in the process of verifying the site-specific swell factor <br />through the use of aerial survey techniques. The company has committed to <br />amending the post-mining topography should the survey indicate a significant <br />difference in the projected swell factor. In order for the Division to verify <br />the swell and post-mining topography, it is stipulated; <br />Stipulation No.6: <br />UPON COMPLETION OF AERIAL MAPPING AND SWELL FACTOR ANALYSIS, THE <br />PERMITTEE SHALL SUBMIT A DISCUSSION WITH ACCOf4PAiVYING VERIFICATION DATA, <br />VALUES, AND FIGURES WHICH DESCRIBES THE RESULTS OF THE CURRENT SWELL <br />FACTOR ANALYSIS, AND AERIAL MAPPING. THE DIVISION WILL kEVIEW THIS <br />DEMONSTRATION AND ISSUE A WRITTEN DECISION AS TO THE ADEQUACY OF THE <br />PROJECTED POST-WINING TOPOGRAPHY. <br />With the acceptance of the above stipulation, the operation is in compliance <br />with the requirements of this section. <br />XVIII. Mine Facilities, Coal Handling Structures, Support Facilities - <br />Kuies z.u5.s) <br />The mine facilities, coal handling structures, and support facilities sections <br />of the application have been reviewed by the Division for compliance. This <br />information can be found in section D of the permit application. <br />All structures and facilities have been designed in accordance with the <br />applicable performance standards. <br />The operation is in compliance with the requirements of this section. <br />XIX. Goal Processin Waste and Non-Coal Processin Waste - Rules <br />2.05.3 8 2.05.3 9 2.05.3 10 2.05.4 2 f 4.10 and 4.11 <br />The Division has reviewed the application for compliance with these sections. <br />Information is contained on page D-3a of the application. This operation will <br />not produce any coal processing waste. All non-coal waste will be <br />appropriately disposed of. <br />The operation is in compliance with the requirements of this section. <br />XX. Roads - Rules 2.U5.3(3)(c)(i) and 4.03 <br />The Division has reviewed the relevant sections of the permit application <br />(Section D, pages 6-g) for compliance. <br />
