-7- <br />Stipulation No. 14 <br />THE APPLICANT MUST INSTALL A STAFF GAGE CLEARLY MARKED WITH THE 60% <br />CLEANOUT ELEVATION IN THE SEDIMENT POND. <br />Status: The Coal Gulch Mine has installed a staff gage as required in <br />this stipulation. This stipulation is satisfied. <br />Stipulation No. 15 <br />BEFORE THE PERMANENT POND DESIGN CAN BE CONSIDERED ADEQUATE, THE <br />APPLICANT MUST JUSTIFY THE USE OF A CURVE NUMBER OF 72. THIS MUST BE <br />DONE WITHIN THIRTY (30) DAYS OF PERMIT ISSUANCE. <br />Status: This stipulation has been satisfied as an abatement to <br />NOV C-86-047 as TR-04. <br />Stipulation No. 16 <br />WITHIN THIRTY (30) DAYS OF PERMIT ISSUANCE, THE APPLICANT MUST PROVIDE <br />THE DIVISION WITH DETAILED POND OUTFLOW CALCULATIONS DEMONSTRATING THAT <br />THE 12-INCH DIAMETER PRINCIPAL SPILLWAY WILL NOT DEWATER THE MAJORITY OF <br />WATER IN THE SEDIMENT POND BEFORE 24-HOURS FOLLOWING A DESIGN STORM. IF <br />THESE CALCULATIONS SHOW AN INADEQUATE HOLDING TIME, THE PRINCIPAL <br />SPILLWAY/DEWATERING DEVICE MUST BE REDESIGNED, AND RECONSTRUCTED WITHIN <br />60 DAYS OF PERMIT ISSUANCE. <br />Status: This stipulation has been satisfied as an abatement to <br />NOV C-86-047 as TR-04. <br />Stipulation No. 17 <br />WITHIN THIRTY (30) DAYS OF PERMIT ISSUANCE, THE APPLICANT WILL SEAL THE <br />POND WITH A NON-TOXIC BENTONITE SEAL TO PREVENT FUTURE INFILTRATION. <br />Status: This stipulation has been satisfied as a result of the issuance <br />of NOV C-86-026 and CO C-86-032 and was resolved as an abatement to the <br />CO. <br />Stipulation No. 18 <br />WITHIN THIRTY (30) DAYS OF PERMIT ISSUANCE, THE APPLICANT MUST SUBMIT TO <br />THE DIVISION FOR APPROVAL A DETAILED PLAN FOR MONITORING THE SEDIMENT <br />POND pH AND TREATING THIS WATER IF NECESSARY. THE TREATMENT PLAN SHOULD <br />INCLUDE THE TYPE AND AMOUNT OF REGENT TO BE UTILIZED, METHOD OF <br />APPLICATION, AND WHEN AND HOW THE PLAN WILL BE IMPLEMENTED. <br />Status: This stipulation has been satisfied as a result of the abatement <br />of NOV C-86-047 as TR-04. <br />
