-5- <br />Stipulation No. 5 <br />1. THE PERMITTEE SHALL CONSTRUCT A DITCH TO INTERCEPT DRAINAGE ABOVE THE <br />PLANT GROWTH MEDIUM STOCKPILES ADJACENT TO THE HIGHWALL/SLOPE AREAS. <br />ALONG THE PERIMETER OF THE STOCKPILES A CONTAINMENT DITCH SHALL BE <br />CONSTRUCTED. <br />2. THE PLANT GROWTH MEDIUM STOCKPILES SHALL BE SEEDED WITH THE APPROVED <br />RECLAMATION SEED MIX, MINUS WOODY PLANT SEEDS, AND MULCHED WITH STRAW OR <br />NATIVE HAY AT 4,000 POUNDS/ACRE DURING THE FIRST APPROVED <br />SEEDING/PLANTING SEASON AFTER PERMIT ISSUANCE. <br />Status: This stipulation has been satisfied as an abatement to <br />NOV C-86-027. <br />Stipulation No. 6 <br />THE REVEGETATION SUCCESS CRITERION FOR THE COAL GULCH MINE SHALL BE 70% <br />LIVE VEGETATIVE GROUND COVER IN ACCORDANCE WITH RULE 4.15.10. <br />Status: The satisfaction of this stipulation will not occur until after <br />the mine is reclaimed. <br />Stipulation No. 7 <br />WITHIN SIXTY (60) DAYS OF PERMIT ISSUANCE, THE PERMITTEE WILL SUBMIT <br />DETAILED DESIGNS FOR BACK FILLING AND GRADING. THESE SHALL ADDRESS <br />REPLACEMENT OF THE EXISTING OVERBURDEN AT THE SOUTHEAST CORNER OF THE <br />PERMIT AREA ALONG THE HIGHWALL WITHIN THE FACILITIES AREA. ALL SLOPES <br />WITHIN THE DISTURBED AREA SHALL BE NO STEEPER THAN 3V:1H. THE PLAN SHALL <br />ADDRESS HOW THE POST-MINING CONFIGURATION MEETS THE REQUIREMENTS OF <br />APPROXIMATE ORIGINAL CONTOUR, AND BLENDS WITH THE SURROUNDING <br />TOPOGRAPHY. THE PERMITTEE WILL SUPPLY CROSS-SECTIONS OF THE PROPOSED <br />POST-MINING TOPOGRAPHY ON 200 FOOT CENTERS THROUGH THE DISTURBED AREA. <br />THE PERMITTEE SHALL ALSO PROVIDE A REVISED POST-MINING TOPOGRAPHY MAP <br />WITH MAXIMUM FIVE-FOOT CONTOUR INTERVALS. THE REQUIREMENTS OF THIS <br />STIPULATION WILL BE SATISFIED ONLY UPON WRITTEN APPROVAL BY THE DIVISION <br />TO THAT EFFECT. <br />Status: This stipulation has been satisfied as an abatement to <br />NOV C-86-045 submitted as Technical Revision (TR)-02. <br />Stipulation No. 8 <br />WITHIN SIXTY (60) DAYS OF PERMIT ISSUANCE, THE PERMITTEE WILL PROVIDE A <br />PLAN FOR DIVISION APPROVAL DISCUSSING PLACEMENT OF COAL FINES DURING <br />RECLAMATION, AND DISPOSAL OF TRASH AND NON-COAL WASTE. <br />Status: This stipulation has been satisfied as an abatement to <br />NOV C-86-045 submitted as TR-02. <br />
