-4- <br />Stipulation No. 2 <br />PRIOR TO ANY ACTIVITY BY <br />ARNESS, AND WITHIN SIXTY <br />SUBMIT COMMENTS FROM ALL <br />PERMIT AREA REGARDING THE <br />WITH RULE 2.05.5 (2) (b). <br />THE PERMITTEE IN ANY AREA NOT OWNED BY Mr. SAM <br />(60) DAYS OF PERMIT ISSUANCE, THE PERMITTEE WILL <br />OWNERS OF RECORD OF THE SURFACE WITHIN THE <br />PROPOSED POST-MINING LAND USE IN ACCORDANCE <br />Status: The applicant has complied with this stipulation and no further <br />action is required. <br />Stipulation No. 3 <br />THE APPLICANT SHALL MONITOR THE QUANTITY OF DISCHARGE FROM THE <br />ABANDONED VICTORY N0. 1 PORTAL ON A MONTHLY BASIS. THE APPLICANT <br />SHALL SAMPLE THIS DISCHARGE QUARTERLY FOR THE PARAMETERS LISTED <br />BELOW. <br />GROUND WATER PARAMETERS: <br />pH (Field) <br />Conductivity (Field) <br />Temperature (Field) <br />Total Dissolved Solids <br />Bicarbonate (as CaCo3) <br />Calcium <br />Carbonate <br />Chloride <br />Magnesium <br />Ammonia <br />Nitrate-Nitrite <br />Phosphate <br />Sodium <br />Sulfate <br />Arsenic <br />Cadmium <br />Iron <br />Manganese <br />Mercu ry <br />Selenium <br />Zinc <br />Status: The requirements for this stipulation are ongoing. Currently <br />the Division only has one quarter of water quality monitoring from this <br />mine (4th quarter 1986) and no monthly flow measurements. To bring this <br />mine into compliance the Coal Gulch must submit monitoring data for water <br />quality for 2nd and 3rd quarters 1986, 1st, 2nd, 3rd and 4th quarters <br />1987 and 1st and 2nd quarters 1988. Monthly flow measurements for the <br />Victory No. 1 discharge must be submitted for 1986, 1987 and the first <br />half of 1988. Failure to submit this information may result in <br />enforcement action. <br />Stipulation No. 4 <br />THE PERMITTEE SHALL REPLACE A MINIMUM OF 12 INCHES OF THE MATERIAL <br />DESIGNATED AS SUITABLE PLANT GROWTH MEDIUM AT THE COAL GULCH MINE ON <br />RECLAIMED DISTURBED AREAS. <br />Status: This stipulations requirements are ongoing and successful <br />satisfaction will not occur until final reclamation. <br />
