-3- <br />floor) will be noted and pH, electrical conductivity and flow measurements <br />will be taken of each source. <br />C. Should this monitoring indicate that there will be the potential for acid <br />mine drainage from the underground mine, the permittee will submit an <br />underground acid mine drainage control plan that will demonstrate that <br />upon final reclamation acid water will not discharge from the portal. <br />This may be demonstrated by predicting the rate of mine inflow, <br />submitting a revised watertight portal design, predicting how far water <br />will back up against the portal seal and at what point mine inflow will <br />reach equilibrium with outflow through the coal seam. <br />During the June, 1988 inspection, sampling of the seeps around the coal <br />stockpile indicated that a considerable amount of acid was being generated (4 <br />gpm at pH 2.1). The portal bench (which is also the high pyrite containing <br />floor or coal underburden) was wet with seeps. Seeps of good quality water <br />were flowing from around the berm and into the coal pile. The wetness and <br />exposure of the floor to the air with the uncontrolled seeps flowing through <br />the coal stockpile probably contribute appreciably to the amount of acid that <br />is generated. Preventing water from coming in contact with potentially acid <br />forming material is the best way to prevent acid mine drainage. <br />The Division is requiring that the permittee submit a seep and drainage <br />control plan to route seeps around the coal stockpile and portal bench and <br />sumps at the bottom of the coal stockpile to collect and treat any acid mine <br />drainage that is generated. Regular sampling of pH and application of lime <br />should be conducted to maintain a neutral pH. This should be submitted as a <br />revision. <br />Legal, Financial, and Compliance Information <br />Given the recent Chapter 11 proceedings and changes in personnel and corporate <br />status, the permittee needs to update as necessary all legal and financial <br />information as outlined in Rules 2.03.4, 2.03.6, and 2.03.9. Additionally, <br />the permittee should provide updated information on compliance as outlined in <br />Rule 2.03.5. <br />IB. Status of Stipulations - The Division has reviewed the current status of <br />e s ipu a ions a were attached to the approval of the permit and to <br />later revisions. The following are the 24 stipulations and their current <br />compliance status. <br />Stipulation No. 1 <br />PRIOR TO PERMIT ISSUANCE, THE APPLICANT SHALL UPDATE, REWRITE AND <br />INCORPORATE ALL CHANGES AND MODIFICATIONS MADE DURING THE REVIEW PERIOD <br />INTO THE PERMIT APPLICATION. THE APPLICANT SHALL PROVIDE THE DIVISION <br />WITH FOUR COPIES OF THE REVISED DOCUMENT. <br />Status: The applicant has updated the permit application as specified in <br />this stipulation. This stipulation has been complied with and no further <br />action is required. <br />
