<br />_11_ <br />A small area exemption has been granted for the office area. This area is <br />described below. All other disturbed areas have drainage routed to sediment <br />ponds. All undisturbed drainage has been routed around the disturbed areas. <br />Pond SP-2, draininy the refuse site, has a very small dewatering orifice <br />(approximately 2 inches). This small orifice will require additional <br />protection to prevent clogging by debris in the pond. Therefore the following <br />stipulation is required. <br />STIPULATION N0. 2 <br />THE PERMITTEE WILL SUBMIT TO THE DIVISION A DESIGN TO PROVIDE FOR <br />NON-CLOGGING FREE OPERATION OF THE ORIFICE IN POND SP-2 WITHIN 30 DAYS <br />OF PERPIIT ISSUANCE. <br />The applicant has not committed to a maintenance program for the ponds at the <br />Eastside Mine. Therefore, the following stipulation is required: <br />STIPULATION N0. 3 <br />THE PERMITTEE WILL PRESENT TO THE DIVISION A PLAN WHEREBY THE 60 <br />PERCENT SEDIMENT VOLUME LEVEL CAN BE MARKED ON PONDS SP-1 AND SP-2. <br />THIS PLAN SHOULD BE SUBMITTED WITHIN 60 DAYS OF PERMIT ISSUANCE. THE <br />PONDS WILL BE MAINTAINED WITH SEDIMENT LEVEL AT OR BELOW THIS LEVEL. <br />Stream Buffer Zones -- Rule 4.05.18 <br />A portion of the surface facilities are located within 100 feet of the <br />perennial Harvey Gap Drainage. The following findings are required in order <br />to allow this practice, <br />The Division finds that: <br />(a) The original stream channel will be restored. Only a small section <br />of the stream channel will be disturbed. A 48 inch culvert will be <br />placed under the haul road to the waste disposal area. This <br />section of stream channel will be restored. <br />(b) During and after the mining, the water quantity and quality from <br />the stream section within 100 feet of the surface coal mining <br />operations shall not be adversely affected. All drainage from the <br />disturbed site is controlled by sediment ponds or filter fabric <br />dams. The quality and quantity of the stream is not projected to <br />be significantly impacted. Signs and markers will be placed to <br />designate the extent of disturbance for the surface facilities. <br />(c) The reclamation plan provides for the reestablishment of <br />appropriate riparian vegetation. There should be no adverse impact <br />to riparian vegetation. <br />
