_lp_ <br />With the acceptance of the above stipulation, the proposed operation is in <br />compliance with the requirements of the Hydrology Sections. <br />Water Quality Standards and Effluent Limitations -- Rule 4.05.2 <br />The applicant has requested a small area exemption from sediment pond <br />treatment for the runoff from the office area. This area is 2 acres in size. <br />All undisturbed drainage has been diverted to flow around the office area. <br />During the construction phase, a filter fabric dam will be installed along the <br />top of the fill in low areas. All drainage during the construction period <br />will pass through the filter prior to entering the natural drainage. Seeding <br />and mulching (at 2 tons per acre) will occur immediately after the completion <br />of the regrading operation. Areas not seeded and mulched will be gravelled to <br />provide an erosion resistant surface. A series of two fabric dams will be <br />placed in the drainage at the southern edge of the site. All drainage from <br />the office area will pass through the filters prior to entering tiie natural <br />drainage. <br />This area meets the requirement of Rule 4.05.2(3) in that the disturbed <br />surface area is small and there is no mixture of surface drainage with <br />discharge from undergound mine workings. With the combination of filter <br />fabric dams, vegetation and mulching, and gravelling, the area should meet the <br />effluent requirements of Rule 4.05.2 and the State and Federal water quality <br />requirements. <br />With the acceptance of the above stipuliation, the proposed operation meets <br />the requirement of this section. <br />VI. Water Rights and Replacement - Rules 2.04.1(3) and 4.05.15 <br />The applicant has not submitted information on any existing water rights for <br />the water infiltrating into the mine. The major source of inflow present at <br />the Nine is surface water contacting the burned coal zone along the portal. <br />This inflow is considered tributary water to Harvey Gap. The applicant <br />proposes to use t~iis water at the surface facilities. This would be a <br />consumptive use with some evaporation occurring off the facilities areas. <br />Therefore, the following stipulation is required. <br />STIPULNTION N0. 4 <br />THE PERMITTEE MUST IDENTIFY THE AMOUNT OF WATER LOST THROUGH THE SYSTEM <br />ANU IDENTIFY, AT A MINIMUM, ALTERNATIVE SOURCES OF WATER FOR <br />AUGMENTATION. THE INFORMATION SHOULD BE SUPPLIED TO THE DIV1S10N <br />WITHIN 60 DAYS OF PERMIT ISSUANCE. <br />With the acception of the above stipulaton, the proposed operation is in <br />compliance with the requirements of this section. <br />
