<br />r~a~~~-0 <br />Two other registered 'storical sites ate Located in Section 26-T4N-R67W - SWL870, the Fort St. <br />Vrain Siding, and L814, the Fort St. Vrain Fur Trading Post. The enclosed copy of the Land <br />Use Plan Exhibit map, which was included with the Platte Trust's and Tom Shazkey's <br />application and petition for annexation to the Town of Milliken, clearly shows that the Platte <br />Trust and Tom Sharkey intend to mine sand and gravel just to the north of the Fort St. Vrain Fur <br />Trading Post site. That gravel pit (and subsequent pond or lake) is designated on that map as <br />Lake St. Vrain. The annexation of the Platte Trust's properties and Tom Shazkey's illegally <br />created properties by the Town of Milliken will allow Tom Sharkey to mine sand and gravel <br />right up to the split rail fence and survey pins, which incorrectly represent the Fort's four outside <br />walls and the property line of the Platteville Historical Society's property. <br />We have serious concerns about the mining of this property and the irrevocable damage that will <br />result to the registered historical sites of the Fort St. Vrain Fur Trading Post and the Fort St. <br />Vrain Siding, along with the site of the Town of Fort St. Vrain and its unmarked cemetery. <br />Please see the attached copy of a referral letter from the Colorado Historical Society to the <br />Division of Minerals and Geology and the attached documentation regarding the Fort St. Vrain <br />Siding from the Colorado Historical Society. Also, please see the attached copy of a deed map <br />that shows the platted Town of Fort St. Vrain and the Fort St. Vrain Fur Trading Post. <br />A++a~ <br />__-_ pOL. <br />z <br />{^ <br />1'/~we~J I <br />Unmarked human graves are located on the Fort St. Vrain Fur Trading Post property, most of <br />which is owned by the Platte Trust (Tom Sharkey). The Platteville Historical Society owns only <br />a small piece of property that incorrectly represents the location of the Fort's four outside walls <br />and inward that was the site of the 1840's Fort St. Vrain Indian massacre, a sacred Indian site. <br />T'he Platte Trust (Tom Sharkey) owns the majority of the Fort St. Vrain Fur Trading Post <br />pioperty. The Platte Trust (Tom Sharkey) also owns the surrounding property where the Town <br />of Fort St. Vrain was located, and the Platte Trust (Tom Sharkey) owns the property where the <br />town's unmarked cemetery is located. <br />Because the Town of Fort St. Vrain's unmarked cemetery is located at the site of this gravel pit, <br />we believe the mining of this property will violate the following Colorado Revised Statutes: <br />Title to Historical, Prehistorical, and Archaeological Resources of Colorado -C.R.S. <br />24-80-401 through 24-80-413, <br />Desecration of Venerated Objects-C.R.S. 18-9-113, <br />Unmarked Human Graves -C.R.S. 24-80-1301 through 24-80-1305. <br />C.R.S. 24-80-1301 -Definitions states: <br />As used in this part 13, unless the context otherwise requires: <br />(1) "Commission" means the commission of Indian affairs. <br />(2) "Disturb "means to move, open, expose, dig up, disinter, excavate, remove, curry away, <br />damage, injure, deface, desecrate, loot, vandalize, mutilate, or destroy. <br />
