<br />(3) "Human remains" means any part of the body of a deceased human being in any stage of <br />decomposition. <br />(4) "Land" means all lands, including submerged lands, located within the state of Colorado <br />which are owned by the state or its political subdivisions, agencies, or instrumentalities or <br />by any private person. <br />(5) "Person" means an individual, limited liability company, corporation, unincorporated <br />association, partnership, proprietorship, or governmental entity. <br />(6) "Unmarked human burial "means any interment of human remains for which there exists <br />no grave marker or any other historical documentation providing information as to the <br />identity of the deceased. " <br />Please see attached copies of these State statutes and various other attachments. Sand and gravel <br />mining on this property will disturb and destroy unmarked human burial sites. <br />Additionally, please see a copy of a September 10, 2002 letter from the Arapaho Business ~; <br />Council, stating that the Northem Arapaho Tribe objected to any disturbance of other desecration <br />of the gravesites of their families -several members of the Arapaho nation were massacred at the <br />Fort St. Vrain Fur Trading Post by Marcellin St. Vrain in the 1840s. This letter also requested <br />that a cultural inventory be undertaken and reviewed by the tribe before a zoning change and <br />variance [in connection with the petition for annexation] was considered. This was never done - <br />the requests of the Northern Arapaho Tril;e were ignored. <br />Had we known that we could have addressed these issues to the Mined Land Reclamation Board <br />during the protest or mitigation hearing before the permit was issued, we would have. However, <br />we were told that water issues were the only issues that would be considered or mitigated at that <br />heazing. <br />Because we are concerned about retaliation, we are submitting this letter and request <br />anonymously. Please revoke permit M-2000-158, which was issued to Platte Sand & Gravel, <br />L.L.C. on August 10, 2001.
