Mount <br />Senior Environmental Protection Specialist <br />Mined Land Reclamation Board <br />Division of Minerals and Geology <br />1313 Sherman Street, Room 215 <br />Denver, CO 80203 <br />RE: REQUEST FOR REVOCATION OF PERMIT <br />Permittee: Platte Sand & Gravel, L.L.C., S & H Mine <br />Permit Number: M-2000-158 <br />Type of Permit 112c <br />Permit Date: August 10, 2001 <br />Dear Mr. Mount: <br />RECEIVED <br />MAY 0 5.2003 <br />Division ~f Minerals and Geology <br />As a result of our recent telephone conversation, I am submitting a request that the Mined Land <br />Reclamation Board revoke the above referenced mining permit. <br />The Platte Sand & Gravel, L.L.C., which was organized by Tom Sharkey and Krystal <br />Hoffschneider, applied and petitioned Weld County for a Use by Special Review Permit (USR) <br />in order to mine sand and gravel on properties west of Gilcrest and northwest of Platteville in <br />Sections 23-T4N-R67W, 26-T4N-R67W, 34-T4N-R67W, 35-T4N-R67W and in Section 2-F3N- <br />R67W. On October 10, 2001, the Weld County Commissioners refused to issue said permit. <br />In 2002, Tom Sharkey and Krystal Hoffschneider deeded their respective properties to the Platte <br />Trust, and the Platte Trust illegally deeded a small portion of the Hoffschneider property to Tom <br />Sharkey without obtaining a recorded exemption. The Platte Trust and Tom Sharkey petitioned <br />the Town of Milliken to annex their properties in order to obtain a sand and gravel mining (USR) <br />permit and, thereby, circumvent the Weld County Commissioner's denial of a USR permit to the <br />Platte Sand & Gravel, L.L.C. <br />As I explained to you in our telephone conversation, we have serious concerns about a registered <br />archaeological and prehistoric Indian ossuary- SWL8] 3, the Ehrlich Burial Site -that adjoins <br />and probably overflows onto the Platte Trust's (Tom Sharkey's) property in Section 26-T4N- <br />R67W. Please see the enclosed copy of a topographical map that identifies several prehistoric, ~~ <br />historical and archaeological sites that have been registered by the Colorado State Historical <br />Society and/or the State Archaeologist's Office. <br />In their annexation agreement with the Town of Milliken, the Platte Trust and Tom Sharkey have <br />stated that they will donate afive-acre piece of ground that adjoins this Indian ossuary site (and <br />that probably includes part of the Indian ossuary site) as a public park to the Town of Milliken. <br />We believe that the users of a municipal public park will endanger and jeopardize the integrity of <br />this archaeological and prehistoric treasure, and that the park users will vandalize and destroy <br />this archaeological and prehistoric site. <br />A ° ~~~ <br />
