that the Colorado Mined Land Reclamation Division be notified within five days <br />after analytical results of the sample collections indicate that noncompliance <br />with a permit condition or applicable standard has occurred (see "Stipulations" <br />in this section of the TEA). <br />Sampling will continue according to the proposed monitoring program until the <br />post-mining reclamation effort is deemed successful by the regulatory agency. <br />This monitoring program may be modified at some ~im€ if deemed necessary (page <br />r Z^'• ;•• Y/i/ a ~cv;,r;...~ <br />II C-64 of the permit application). As part of the surface facilities, surface <br />water monitoring devices will be removed when reclamation is deemed complete by <br />the regulatory authority. <br />Discharge of Water into an Underground Mine <br />The D-Portal Area and Ventilation Entry Area "portals" will be constructed so <br />that they will be, above the 500 year flood elevation of Scullion Gulch (page <br />r <br />V-28 of the permit application). Therefore, uncontrolled flow from flooding <br />events will not discharge into the mine. <br />Water pumped from the mine itself will be stored in a holding tank on the <br />surface for use in the mine, or treated for sediment removal in the process <br />.pond for use amongst the various surface facilities (page II. C-106 of the <br />permit application). If storage capacities are exceeded by mine inflow an <br />NPDES permit will be obtained to discharge the water. <br />Postmining Rehabilitation of Sedimentation Ponds, Diversions, Impoundments and <br />Treatment Facilities <br />The applicant intends to completely reclaim all ditches, berms, ponds, embank- <br />ments and diversions at the mine site. All surface water control structures <br />will be regraded, topsoiled and revegetated after the appropriate regulatory <br />agencies have deemed them no longer necessary for the reclamation process. <br />27 <br />
