. -18- <br />The estimated water requirement made by the Soil Conservation Service for the <br />108 acres of irrigated pasture is 5.4 cfs. The mining operation will consume <br />0.250 of the excess 3.1 cfs. Thus the crombined consumptive use of the mining <br />operationandof the agricultural activities on Mel Martinez property will not <br />exceed the total appropriated right of 8.5 cfs. However, when there is a call <br />by water rights senior to the two junior rights owned by Mel Martinez, any use <br />of water by the mining operation may impact downstream water rights and the one <br />senior water right owned by Mel Martinez. The impact of water withdrawal during <br />periods when there is a call on water may also be significant to agricultural <br />activities on adjacent and downstream alluvial valley floors. Therefore a <br />stipulation has been placed upon this permit which can be found in the Alluvial <br />Valley Floor section of this permit document. <br />The proposed operation is in compliance with the acceptance of the aforementioned <br />stipulation. <br />VZII. Alluvial valley Floors -Rules 2.06.8, 2.07.6(2)(k), and 4.24 <br />Alluvial Valley Floors (AVF~s) have been determined by the Division to exist <br />along the Stollsteimer Creek Valley upstra3m, adjacent to, and downstream of <br />the permit area. The applicant has performed a recronnaissance level alluvial <br />valley Floor study which can be found in Section 2.06, Volume I of the permit <br />application, and in responses to adequacy questions dated September 16 and <br />September 27, I982. <br />The valley formed adjacent to Stollsteimer Creek was determined to be an AVF <br />for the following reasons: <br />1. the valley contains unconsolidated streamlaid deposits; <br />2. the area has historically been flood irrigated; and <br />3, the area is potentially sub-irrigated. <br />Alluvial galley Floor Findings <br />1. Rule 2.06.8(5) (a) (i) (R) (I) <br />Mel Martinez, landowner, owns the adjacent AVF and surrounding lands. Xe <br />is presently engaged in agricultural practices on 450 acres of land. Of this <br />950 acres, 108 are irrigated pasture (the adjacent RVF). The mining operation <br />is proposing to remove 12.5 acres of the irrigated pasture from production <br />which accounts for II.So of the areal extent of the pasture land and 20 <br />of the entire land area to be used for agricultural practices. <br />
