[Dater Rights and Replacement - Rules 2.04.7(3), 2.05,6(3)(a)(ii), <br />2.07.6(2)(c), and 4.05.15 <br />Information pertaining to water rights and replacement can be found in Section <br />2.04, Volume I and Exhibit 29, Volume IV of the permit application, and <br />responses to preliminary adequacy questions submitted on September 16, 1982 <br />and September 27, 1932. <br />The applicant's surface water rnntrol plan does not ca 11 for the permanent <br />impoundment of r,~ater. Sediment ponds at the site are the only structures <br />that would impound water and then only in the event of a precipitation event. <br />Water use at the site is limited to dust suppression and domestic use. <br />Lbmes tic water is supplied by a permitted domestic well located at the site. <br />The amount of water consumed by the mine for dust suppression is about 5,000 ppd. <br />The applicant receives the right to the water used for dust suppression tl:rcugh <br />a written agreement cri*h Mel Martinez. Afe1 hfartinez has an adjudicated :rater <br />right to 3.5 cfs of the flow in StoIlsteimer Creek. The hfartinez water right <br />contains three appropriations, one for 2.5 cfs which is senior to a1I do:~+nstream <br />water rights and two for 6.0 cfs which are senior to all but two downstream water <br />rights (totaling 2.0 cfsl. <br />
