11. Sunland Mining Corp. has requested a negative determination as to the presence of <br />prime farmland at the Apex No. 2 Mine. The Division made such a negative <br />determination for the initial five-year permit and no information has been submitted <br />to change this determination. Therefore, the Division reaffirms a negative <br />determination on the existence of prime farmland at this site. Information pertaining <br />to prime farmland is presented on page 123 of the permit application. <br />12. Based on information provided in the application the Division has determined that <br />an alluvial valley floor exists within the permit or adjacent area. The alluvial valley <br />floor is lmown as the Trout Creek alluvial valley floor and will be effected by the <br />existing operation (2.07.6(2) and 2.06.8(3)(C)). <br />For additional specific findings concerning this alluvial valley floor please see <br />Section B, XVII. <br />13. Sunland Mining Corp. proposes to return the area to its original land use of <br />rangeland and wildlife habitat with the exception of Routt County Road 29. Based <br />upon a request from Sunland, the Division assisted in developing the seed mixture <br />presented on page 184 of the permit application. This seed mixture was used during <br />final reclamation of this mine site and does not have any shrub species. The <br />landowner has requested that no shrubs be planted to allow for more growth of <br />desirable grass and forb species for grazing purposes. Due to the limited areal <br />extent of the area to be reclaimed and the wooded nature of adjacent areas, the <br />Division has agreed to this request. <br />Along with developing the revegetation plan, Sunland Mining Corp. also requested <br />assistance in developing the revegetation success criteria. Because of no true <br />baseline data from the Apex No. 2 Mine, the revegetation success criteria were <br />developed by averaging premising data from adjacent mines taking into <br />consideration the limitations of this site. The approved success standards are <br />presented on page 184.1 of the permit application. <br />14. Specific approvals have been granted and are proposed. These approvals are <br />addressed in the foIIowing section, Section B. (2.07.6(2)(m)). <br />15. The Division finds that the activities proposed by the applicant would not affect the <br />continued existence of endangered or threatened species or result in the des ruction <br />or adverse modification of their critical habitats. (2.07.6(2)(n)). <br />16. The Division has contacted the Office of Surface Mining, Reclamation Fees Branch. <br />As of this time, May 3, 1993 the operator is current in the payment of reclamation <br />fees required by 30 CFR Chapter VII, subchapter R.
