5. Based upon information submitted by Sunland Mining Corporation and from the <br />State Historic Preservation Office, the Division finds that this operation will not <br />adversely affect any areas considered eligible for the National Register of Historic <br />Places. (2.07.6(2)(e)(i)). Information pertaining to cultural and historic resources <br />can be found on pages 14-22 of the permit application. <br />6. For this surface mining operation, private mineral estate has not been severed from <br />private surface estate, therefore, the documentation specified by Rule 2.03.6(2) is <br />not required. (2.07.6(2)(f)). <br />7. On the basis of evidence submitted by the applicant and received from other state <br />and federal agencies as a result of the Section 34-33-114(3) compliance review <br />required by the Colorado Surface Coal Mining Reclamation Act, the Division finds <br />that Sunland Mining Corporation does not own or control any oper;[[ions which are <br />currently in violation of any law, rule, or regulation of the United States, or any <br />State law, rule, or regulation, or any provision of the Surface Mining Control and <br />Reclamation Act or the Colorado Surface Coal Mining Reclamation Act. <br />(2.07.6(2)(g)(i)). <br />8. The Sunland Mining Corporation does not control and has not controlled mining <br />operations with a demonstrated pattern of willful violations of the Act of such <br />nature, duration, and with such resulting irreparable damage to the environment as <br />to indicate an intent not to comply with the provisions of the Act. (2.07.6(2)(h)). <br />9. The Division finds that surface coal mining and reclamation operations to be <br />performed under this permit will not be inconsistent with other such operations <br />anticipated to be performed in areas adjacent to the permit area. (2.07.6(2)(1)). <br />10. The Apex Mine is currently bonded for $172,020.00. This amount reflects the bond <br />needed to reclaim the maximum disturbance of the mining operation. During the <br />fall of 1992 Sunland Mining Corp. removed all surface structures and conducted <br />considerable bacldilling and grading at the mine area. Therefore, the actual <br />reclamation liability amount is less than the bond amount. The reclamation bond is <br />a corporate surety issued by the Aetna Casualty and Surety Company. The last rider <br />was issued in March of 1992. The current bond amount reflects the minimum bond <br />that Sunland Mining Corp. must maintain without a phase I bond release. <br />The current reclamation liability was last calculated July 1991. At that time the <br />calculated maximum liability was increased from $80,600.00 to $172,020.00. <br />Reclamation activities conducted this past fall by the mine have reduced the mine's <br />liability and for the purpose of this renewal a recalculation was not performed <br />(2.07.6.(2)(j)). <br />Apex No. 2 Mine, C-81-011 11 May 5, 1993 <br />
