SECTION B
The following findings and specific approvals are required by Rule 4
I. Roads -Rule 4.03
Haul Roads
There aze no haul roads at the Apex No. 2 Mine. Routt County Road 29 passes
between the facilities area and the portal bench. Specific approvals are not reyuired
for this section (4.03.1(1)(e)).
Access Roads
There was a small portal access road that has been reclaimed. Specific approvals
aze not required for this section.
II. Support Facilities -Rule 4.04
The support facilities, as described in the preceding "description of the operation
and reclamation plans" have been reclaimed with the exception of the
shop/bathhouse structure. The shop and bathhouse were left at the request of the
land owner. Specific approvals are not required for this section. (4.04(6)).
III. Hydrologic Balance -Rule 4.05
A. Water Quality Standards and Effluent Limitations
For two small areas the applicant has demonstrated that sediment ponds and/or
treatment facilities are not necessary for drainage to meet the effluent limitations of
4.05.2 and the applicable State and Federal water quality requirements for
downstream receiving waters. Therefore, the Division proposes to grant an
exemption from these requirements. This exemption applies to two small areas, that
are the previous office trailer and parking lot locations and the reclaimed fan portal.
These are .35 and .OS acres respectively. (4.05.2(3)(a)).
The Division proposes to grant a small area exemption from use of sediment ponds
due to the limited size of the area and due to the fact that ponds and treatment
facilities are not necessary for the drainage to meet the effluent limitations of Rule
4.05.2, and applicable State and Federal water quality standards for receiving
Apex No. 2 Mine, C-81-011 13 May 5, 1993
