SECTION B <br />The following findings and specific approvals are required by Rule 4 <br />I. Roads -Rule 4.03 <br />Haul Roads <br />There aze no haul roads at the Apex No. 2 Mine. Routt County Road 29 passes <br />between the facilities area and the portal bench. Specific approvals are not reyuired <br />for this section (4.03.1(1)(e)). <br />Access Roads <br />There was a small portal access road that has been reclaimed. Specific approvals <br />aze not required for this section. <br />II. Support Facilities -Rule 4.04 <br />The support facilities, as described in the preceding "description of the operation <br />and reclamation plans" have been reclaimed with the exception of the <br />shop/bathhouse structure. The shop and bathhouse were left at the request of the <br />land owner. Specific approvals are not required for this section. (4.04(6)). <br />III. Hydrologic Balance -Rule 4.05 <br />A. Water Quality Standards and Effluent Limitations <br />For two small areas the applicant has demonstrated that sediment ponds and/or <br />treatment facilities are not necessary for drainage to meet the effluent limitations of <br />4.05.2 and the applicable State and Federal water quality requirements for <br />downstream receiving waters. Therefore, the Division proposes to grant an <br />exemption from these requirements. This exemption applies to two small areas, that <br />are the previous office trailer and parking lot locations and the reclaimed fan portal. <br />These are .35 and .OS acres respectively. (4.05.2(3)(a)). <br />The Division proposes to grant a small area exemption from use of sediment ponds <br />due to the limited size of the area and due to the fact that ponds and treatment <br />facilities are not necessary for the drainage to meet the effluent limitations of Rule <br />4.05.2, and applicable State and Federal water quality standards for receiving <br />Apex No. 2 Mine, C-81-011 13 May 5, 1993 <br />
