Exhibit B <br />(continued) <br />Permit Stipulations and Their Status <br />Number <br />Stipulation <br />Status <br />Peabody Coal Company will submit an annual Ongoing, <br />hydrologic report to the D ivision following being <br />each water year (October 1 to September 30), complied <br />This report shall include all of the reduced with. <br />and tabulated surface and ground water data <br />collected during the year. An interpretation <br />of the data and a discussi on of possible <br />trends should be included in the report. This <br />report shall be submitted to the Division no <br />later than February 28th o f the following year. <br />6 Peabody Coal Company must provide a detailed <br />description of the measures to be taken <br />during and after mining to ensure protection <br />or mitigation of the rights of water users <br />which may be adversely affected by mining. <br />This should be submitted to the Division for <br />approval within 60 days of permit issuance or <br />prior to any disturbance within the mine <br />permit boundary. At the same time as <br />submittal to the Division, Peabody must send <br />copies to each of the water rights holders of <br />record for comment. <br />Prior to disturbance the applicant shall <br />submit vegetative information for the <br />communities to be disturbed during the <br />construction of the Tie Across Haul Road to <br />verify the comparability of vegetative <br />communities to be disturbed under the new <br />proposed alignment and those proposed to be <br />disturbed under the old alignment. <br />The following aspects of the Seneca II-W Mine <br />revegetation plan will be implemented or <br />modified as stated below: <br />A.
