Fennern and Melvin R. Gydesen, doing business <br />as Lucky Strike Mines, J.V., the current lessee of the Gold Links Mine. <br />On October 26, 1994 you advised Mr. Bili Gydesen of your determination <br />that the Gold Links Mine was a Designated Mining Operation. Mr. Gydesen gave a <br />written appeal to that decision by a letter to you dated November 18, 1994, a copy <br />of which is attached. The purpose of this letter is to amplify and set forth further <br />reasons as to why Lucky Strike Mines, J.V. disagrees with your designation and why <br />no such designation should be made. <br />1. The Gold Links Mine is not an operating mine, has not been an <br />operating mine for many years and no active work, whether in mining activities, <br />exploration or otherwise, has taken place on this property for a long period of time. <br />2. While the Gold Link Mine lessees believe that gold and silver are <br />available in commercial quantities from this mine, lack of operating funds and time <br />have prohibited them from taking any affirmative action of any nature. <br />3. There are not any ongoing operations by which any materials of <br />any nature are being disturbed. <br />4. Basically, there are no mine tailings or old tail materials. The <br />materials next to the portal are in fact waste rock and is not a tailing pile nor does it <br />consist of toxic or acid forming materials. <br />5. No acid mine drainage is now occurring nor, in the opinion of our <br />clients, has the potential to occur due to any mining of reclamation activities. <br />
