Nelson, P.E., Industrial Unit Chief <br />Colorado Department of Public Health and Environment <br />December 1, 1994 <br />Page two <br /> <br />In accordance with the permit policy for mining activities, the Gold Links <br />Mine should be classified as inactive/abandoned mines. Since there is no significant <br />water pollution problems no permitting would be required. <br />There has also been significant misunderstanding as to this inactive mine. <br />The mine tailings were removed a generation ago and no mine tailings in the historic <br />sense are in place on this property. the only material in any proximity to the mine <br />portal is strictly awaste-rock pile with no known toxic nor acid content. The water <br />flowing from the mine portal is strictly astream-flow water situation where water <br />enters the mine significantly upstream from the mine portal and then proceeds through <br />the mine portal and back into Gold Creek. <br />Even if this were to be classified as exploratory mining activities, which <br />it definitely is not, you would have an old existing mine with historic drainage. To our <br />knowledge, the receiving waters are meeting WQS and again, since there is no <br />exploratory activity of any nature, no permit would be required. <br />Mr. Gydesen had understood that if this information was properly <br />presented to your office, no discharge permit would be required. Accordingly, we <br />request your favorable decision that no water discharge permit will be required as to <br />this abandoned mining operation. If in the future there were to be any change of <br />circumstances and any mining or exploration activity was to be resumed, our client <br />would promptly notify you thereof. <br />HFR:ajs <br />Enclosures <br />cc: Joel W.
