Fennern and Melvin R. Gydesen, doing business
as Lucky Strike Mines, J.V., and Fennern and Gydesen Heavy Equipment Company.
This partnership leases the Gold Links Mine from the Gold Links Mining Corp.
Reference is made to your letter of July 15, 1994, a copy of which is
attached and Mr. Gydesen's response to you dated November 18, 1994, a copy of
which is also attached.
It is the position of our client that a Colorado Discharge Permit System
permit is not necessary for this site.
First of all, the water sample taken by the Division of Minerals and
Geology on June 17, 1994 was not even furnished until a letter dated October 26,
1994. The Environmental Protection Agency's water analysis evidences that the
water quality is at a satisfactory level and there is no acid or toxic material. Because
of the inability to obtain the EPA Water Quality Analysis, our clients further had Mark
Templeton, Gunnison County Sanitarian, take separate water samples in Gold Creek
above the mine, at the mine portal and in Gold Creek below the mine portal. Those
water samples were analyzed by Grand Junction Laboratories and those water
analyses show that there is no acid or toxic discharge from the mine portal and that
the water quality is acceptable and should meet all required standards. Those water
analysis reports are further attached.
The Gold Links Mine is not an active mine and has not been actively
mined for many years. The lease by our clients is basically an inactive lease and no
mining activity or exploration has been done nor is planned to be done in the future
unless or until world gold market conditions make it feasible to consider utilizing this
property.
NARRISON F. gV$$ELL 120 NORTH TAYLOR STREET TELEPHONE
RUSSELL N.
