Fennern and Melvin R. Gydesen, doing business <br />as Lucky Strike Mines, J.V., and Fennern and Gydesen Heavy Equipment Company. <br />This partnership leases the Gold Links Mine from the Gold Links Mining Corp. <br />Reference is made to your letter of July 15, 1994, a copy of which is <br />attached and Mr. Gydesen's response to you dated November 18, 1994, a copy of <br />which is also attached. <br />It is the position of our client that a Colorado Discharge Permit System <br />permit is not necessary for this site. <br />First of all, the water sample taken by the Division of Minerals and <br />Geology on June 17, 1994 was not even furnished until a letter dated October 26, <br />1994. The Environmental Protection Agency's water analysis evidences that the <br />water quality is at a satisfactory level and there is no acid or toxic material. Because <br />of the inability to obtain the EPA Water Quality Analysis, our clients further had Mark <br />Templeton, Gunnison County Sanitarian, take separate water samples in Gold Creek <br />above the mine, at the mine portal and in Gold Creek below the mine portal. Those <br />water samples were analyzed by Grand Junction Laboratories and those water <br />analyses show that there is no acid or toxic discharge from the mine portal and that <br />the water quality is acceptable and should meet all required standards. Those water <br />analysis reports are further attached. <br />The Gold Links Mine is not an active mine and has not been actively <br />mined for many years.
