The water flowing through the mine does not flow over, across or <br />through any mineral tailings or toxic or acid forming materials. <br />7. The approved mining and reclamation plan for this Permit did not <br />provide for mandatory removal of the tailings but provided that under the Permit old <br />tailings could be hauled away from the site for milling purposes. This is not going to <br />be done. <br />8. Attached is a copy of the water analysis done by the <br />Environmental Protection Agency at the request of Bob Oswald at the time of his <br />inspection of the mine on June 17, 1994. For reasons totally unknown to us, it only <br />took four months to finally be advised of the results of that water analysis which most <br />certainly reveals that there is no acid mine drainage occurring and the water meets all <br />relevant standards. Because of the time period that expired and concern that the <br />result of this test were not to be made available to my clients, Lucky Strike Mines, <br />J.V. had Mr. Mark Templeton, the Gunnison County, Colorado Sanitarian, take <br />separate water samples in Gold Creek above the mine, at the mine portal and in Gold <br />Creek below the mine portal. The water analysis of those samples by the Grand <br />Junction Laboratories are further attached. Again, the water meets all water quality <br />standards. <br />In conclusion, there is no acid mine drainage, no shown potential for acid <br />mining drainage and no drainage is occurring due to mining or reclamation activities. <br />There is not nor has there been any mining activities on this property and most <br />certainly no disturbance of any defined tailing materials.
