M ~ <br />RMR-CU RE~i000-003 <br />will vary depending on the extent of disturbance under an approved Plan of <br />Operation. Under this permit, until a new Plan of Operations and <br />Reclamation Plan are approved, and realistic estimates of reclamation <br />costs have been made, an interim bond of $5,000 is required. oes the <br />$5000 Wilcox has alrea~ deposited with State qualify for this <br />condition"1 <br />36.` In the event the approved plan of Operations is revised or supplemented, <br />the Superintendent may adjust the amount of the bond or security deposit to <br />conform to the Plan of Operations as modified. The bond or security <br />deposit shall be based on an estimate of total acres to be disturbed on the <br />expiration date of the permit. <br />37. The operator's and his surety's responsibility and liability under the <br />performance bond or security deposit shall continue until such time as the <br />Superintendent determines that all terms and conditions of the Plan of <br />Operations have been complied with and successful reclamation of the area <br />of operations has occurred. <br />38. When all reclamation requirements of the Plan of Operations are <br />completed, the Superintendent shall notify the operator that the performance <br />under the bond or security deposit has been completed and that it is <br />released. ' <br />39. In consideration for obtaining the privileges granted herein, the <br />permittee agrees to indemnify and save hazmless the United States from any <br />loss to it, including not only damage to Government property and injury to <br />Government employees, but also judgement, settlements, or compromises <br />for property damage, illness or injury to all persons for which the United <br />States may be liable resulting from the exercise of the permittee and its <br />employees of the privileges granted. <br />40. Upon completion of operations, the disturbed area on NPS lands shall be <br />reclaimed as follows and in accordance with details outlined in the Plan of <br />Operations: <br />Topsoil shall be removed and stockpiled prior to removal of overburden, <br />Stockpiles shall be located so as not to be covered by spoil materials and <br />to facilitate their use in final backfilling and grading. <br />All gravel used on the road surface and any culverts shall be removed, <br />The lands shall be recontoured per the Plan of Operations. <br />Compacted soil shall be ripped to the depth of compaction. <br />Topsoil is to be redistributed on the road surface and recontoured to <br />original slopes and then scarified if necessary. <br />
