-16- <br />Further discussion of surface water can be found in Section VII "Probable <br />Hydrologic Consequences of Mining and Cumulative Hydrologic Impacts <br />Hssessment". <br />Sediment Control <br />The design calculations and narrative for the sediment control system can <br />be found in Volume I, Section 2.05, page 13-25, Section 4.05, page 9, and <br />Section V of the Response to Draft Findings Document Stipulations <br />document. <br />No exemptions from sediment control or effluent quality limitations were <br />requested or granted. The operator was however, granted a variance from <br />two design requirements. Normally, ponds are required to be dewatered <br />automatically. The Division granted a variance from this requirement <br />since all ponds will be incised below ground level. Manual dewatering <br />devices are the only practical method in this case. <br />Another variance was granted from the requirement of submitting detailed <br />pond dimensions. This was granted since the ponds are incised and will <br />need to be field built to accomodate natural land features. However, to <br />ensure that the pond will be built to the proprr size, the Division <br />imposes the following stipulation: <br />Stipulation No. 2 <br />WITHIN 60 UNYS OF CONSTRUCTION OF A SEDIMENT PUNU THE, OPERATOR <br />SHALL 1) SUBMIT CERTIFIED AS-BUILT DESIGNS FOR THE PONDS SHOWING <br />DIMENSIONS NND ELEVATIONS AND 2) SUBMIT H REPORT CERTIFIED BY N <br />QUALIFIED REGISTERED PROFESSIONAL ENGINEER THAT STATES THAT THE <br />POND WAS CONSTRUCTED ACCORDING TU THE APPROVED PLAN CONTAINED IN <br />THE APPLICNTION. <br />Upon submittal of the above, the Division will determine whether the <br />structures are sized for the appropriate design event. <br />In addition, the permittee must submit certification for the existing <br />pond: <br />Stipulation No. 3 <br />WITHIN 60 DAYS OF PERMIT ISSUANCE, THE PERMITTEE MUST SUBMIT A <br />REPORT CERTIFIED BY A QUALIFIED REGISTERED PROFESSIONAL ENGINEER <br />THAT STATES THAT THE EXISTING SEDIMENT POND WAS CONSTRUCTED <br />ACCORDING TO THE APPROVED PLAN INCLUDED IN THE AUGUST 10, 1982 <br />kEVISIUIV. <br />With the acceptance of the above stipulations the Division finds the <br />application in compliance with the requirements of this section. <br />
