<br /> <br />The Division finds that the proposed activities will not threaten the <br />continued existence of endangered or threatened species or result in the <br />destruction or adverse modification of their critical habitats as determined <br />under the Endangered Species Act of 1973 or the Nongame, Endangered or <br />Threatened Species Act. <br />The application is in compliance with the requirements of this section. <br />XIV. Prime Farmland - Rules 2.04.12, 2.06.6, and 4.25 <br />------------------------------------------------ <br />The proposed loadout site is underlain by gravel. Therefore, due to soil type <br />limitations, no prime farmland is present. <br />The application is in compliance with the requirements of this section. <br />XV. Operation Plan - Rules 2.05.2 and 2.05.3 <br />Coal haul trucks will travel from the Coal Ridge No. 1 Mine west along <br />Garfield County Road 335 to the New Castle Interchange of Interstate 70, then <br />west on the interstate 18 miles to the West Rifle Interchange, and finally 1.5 <br />miles west on the frontage road to the loadout site. <br />Up to 10,000 tons of coal will be stored in a stockpile overlying a sump with <br />synthetic liner. The margin of the stockpile will be bermed to prevent <br />surface water from entering or leaving the structure, and any water collected <br />in the sump will be used for treating the coal as required by the Air Quality <br />permit. <br />A front-end loader will be used to load coal into the hopper of a stationary <br />loading conveyor as the rail cars are moved past the loading point. Following <br />loading, an A-frame built over the tracks will shape the coal in each car, <br />which will then be sprayed with latex to minimize loss of coal dust. <br />The application is in compliance with the requirements of this section. <br />XVI. Reclamation Plan - Rule 2.05.4 <br />Reclamation of the loadout site will consist of removal of the facilities on <br />the surface, regrading of the sediment control structures and the coal <br />stockpile sump, and cleanup of any coal on the site. The pre-existing network <br />of structures which route upland runoff around the industrial park will not be <br />removed. There is no topsoil in the permit area, and only a small area of <br />first-stage successional vegetation is present, so there will be no <br />revegetation requirements. <br />The application is in compliance with the requirements of this section. <br />-10- <br />
