Memo to: PCPC • • <br />Re: SUP No. 570 (2nd amended) <br />December 10, 1996 <br />Page 4 <br />Air Pollution Permit - In a phone conversation with Emmet Hance (City/County Health <br />Department, Air Pollution Control) on December 1, 1995, staff was told the applicant <br />does possess valid Emissions Permits for a Batch Plant (No. 86PB042(1)) and the <br />Extraction Operation (No. No. 86PB042(2)F). <br />Colorado Wastewater Discharge System Permit -The applicant has two permits (Nos. <br />COG 500000 and 500092) from the Colorado Department of Health. These permits <br />allow the applicant to discharge groundwater and wash plant water to the Arkansas <br />River. <br />Corps of Engineers -Southwest has been granted Section 404 Permits for the Rich Pit <br />(Permit No. 1994 - 30374), for bank stabilization (Permit No. 1994 - 30391), and for <br />channel work and channelization (Permit No. 1996 - 30200). <br />OTHER AGENCY COMMENTS <br />The Pueblo County Department of Public Works memo of December 5, 1996, indicates <br />no comments regarding this permit. <br />Staff spoke with Mr. Eric Harper, Colorado Division of Wildlife, on December 9, 1996, <br />regarding the condition of approval no. 2 from December 9, 1995. This condition <br />required the applicant to incorporate the CDOW recommendations from a CDOW letter <br />of December 5, 1994, into the reclamation plan. The applicant has submitted a <br />reclamation plan which does not incorporate the tree planting request per the CDOW <br />letter of December 5, 1994, but justifies this omission on the basis of water <br />requirements and the costs of augmentation for evaporative losses from tree planting, <br />particularly in light of the Kansas-Colorado water lawsuit. Mr. Harper indicates that the <br />CDOW will accept this modification, but reiterates the remaining stipulations of the <br />reclamation plan are important and should be followed. <br />United States Deoartment of the Interior, Bureau of Land Management - In a letter <br />dated January 5, 1995, this agency informed staff that problems existed regarding the <br />legal description of the property occupied by Southwest Ready Mix. Apparently, two <br />different surveys were made of the area; one was made in 1869 the other in 1871. It <br />was noted the way the lots were numbered and boundary lines established may cause <br />some confusion. <br />The BLM Area Manager informed staff the only way this situation can be resolved <br />legally is if the BLM Cadastral Division re-surveys the land.
