Memo to: PCPC • • <br />Re: SUP No. 570 (2nd amended) <br />December 10, 1996 <br />Page 5 <br />notice" that any use of the land north of the Arkansas River encompassed within the <br />NE1/4NW1/4 Section 3, without a permit issued by the BLM, may at some future time <br />subject Southwest Ready Mix, and also the present owners of Lot 3 if they should <br />receive any monetary payments from Southwest Ready Mix, to Trespass Action by the <br />United States. <br />Staff conducted an on site investigation of the property on December 5, 1996, <br />and observed the following (Exhibits 4a-c): <br />The existing mining and processing and Redi-mix batch plant operations <br />associated with SUP No. 570 were operating in a well managed and <br />orderly fashion. <br />No mining activity appears to be taking place on property in the area <br />commented on by the BLM. <br />Staff is requesting an amended set of conditions to allow for a more <br />proactive administration of local mineral extraction operations. The <br />following conditions do not alter the intent of the original conditions of <br />approval, but they will provide greater administrative coordination among <br />the various agencies having jurisdiction. <br />RECOMMENDATION <br />Staff recommends APPROVAL of Special Use Permit No. 570 with the following <br />amended conditions: <br />The applicant shall provide the Department of Planning and Development with a <br />copy of any Federal, State, or local permit applications, approvals, <br />amendments, or releases (e.g., air quality, MLRB, augmentation, etc.) <br />pertaining to Special Use Permit No. 570 within 30 days of their submittal to the <br />respective agency and/or approval by the respective agency. <br />2. The applicant shall file a copy of their Annual Mined Land Reclamation Report <br />with the Department of Planning and Development at the time it is submitted to <br />the State of Colorado, Department of Natural Resources, Mined Land <br />Reclamation Division. <br />
