<br />for RN-02. Stipulations are a binding part of the permit and previously assigned stipulation <br />numbers are not to be re-used. Any stipulations associated with this permit and issued over the <br />life of this operation which are not discussed in this mid-term review have been complied with <br />or terminated. <br />Stipulation #9 was identified as active in the DMG database. It required that the operator <br />install an alluvial well in the Ciruela Canyon alluvium immediately downgradient of the <br />Golden Eagle development waste pile. Well CLAW-1 exists in this location and is part of the <br />current hydrologic monitoring program. This stipulation was not included in the permit <br />renewed June 1994. This stipulation was therefore terminated as part of the midterm review <br />process. <br />Stipulation # 16 was also not included in the permit renewed June 1994. This stipulation dealt <br />with redistribution of topsoil on the reclaimed area. All topsoil was re-distributed on the site <br />in 1996 in accordance with the approved plan. This stipulation was also terminated as part of <br />the midterm review process. <br />Stipulation #28 was attached to the permit renewal in June 1994. It was in existence since at <br />least Aprii 1986 as indicated in a stipulation status document found in the stipulation response <br />file. This stipulation required that the operator comply with the requirements of Rule <br />2.05.6(6)(c)(I)(D). However, stipulating that an operator comply with regulatory requirements <br />is redundant. This stipulation was therefore terminated as a result of this midterm review. <br />Termination of this stipulation does not waive any requirement by the operator to comply with <br />any Board regulations. <br />Stipulations #38 and #39 were not attached to the permit renewed June 1994. However, the <br />DMG database lists these stipulations as active. Both stipulations require additional bond be <br />submitted. It is very likely that they are the same stipulation in content, as the required bond <br />amount and the date of origination are the same. These stipulations required additional bond <br />be submitted, prior to any additional, major construction undertaken on the refuse facility. <br />Since the refuse area (development waste pile) is now reclaimed, the mine is adequately <br />bonded, and is in the final stages of reclamation (monitoring and maintenance), these <br />stipulations were terminated as part of this midterm review. <br />Stipulation #40 was not attached to the permit renewed June 1994. This stipulation required the <br />submittal of the appropriate permitting information for the venting of methane gas to the <br />atmosphere. The source of this methane gas was the degas wells installed by the operator. <br />Since that time, all degas holes have been changed to industrial land use. The appropriate <br />permitting has been done through the Colorado Oil and Gas Conservation Commission, who <br />regulates this activity, and methane gas is being produced for retail sale by a local gas <br />development company. Therefore, this stipulation was terminated as part of the midterm <br />-7- <br />
