C7 <br />review process. <br />• <br />Stipulation #50 was attached to the permit renewed in June 1994. This stipulation required an <br />archaeological survey of areas to be affected as a result of PR-O1. Review of the file indicates <br />that the State Historic Preservation Office (SHPO) granted clearance for this area. PR-Ol <br />added 5,674 acres to the permit area, with no additional surface disturbance proposed. Due to <br />the fact that the mine is no longer operational and is in permanent cessation, this stipulation <br />was terminated as part of the midterm review process. <br />Stipulations #51-#53 were also attached to the permit renewed in June 1994, as a direct result <br />of PR-O1 and the proposed plan to undermine a portion of Wet Canyon. These stipulations <br />addressed the need for a hydrologic survey of Wet Canyon prior to undermining. Mining <br />terminated well in advance of the need for this survey. Therefore, these stipulations were <br />terminated as part of the midterm review process. <br />Stipulation #54 was not issued as a result of permit renewal in June of 1994. The DMG <br />database indicates this stipulation required submittal of bonding for reclamation of activities <br />associated with Notice of Intent (NOI) CX-91-173-23 and MR-22. The Division holds a bond <br />in the amount of $90,000.00 for NOI CX-91-173-23 and is appropriately bonded with regard <br />to MR-22. The operator has since reclaimed these sites and is in the process of applying for <br />bond release. Therefore, this stipulation was terminated as part of the midterm review <br />process. <br />Stipulation #63 was not attached to the permit renewed in June of 1994. This stipulation <br />required that the operator protect the fish in the river intake ponds. These ponds are no longer <br />in service as the mine is reclaimed. A small amount of water remains in the first of the two <br />ponds, with the second pond observed as dry during the most recent inspection conducted <br />April 20, 1998. Blue Heron were also noted fishing in these ponds this spring. Any fish in <br />these ponds would be subject to natural predation and to winter kill during a potential freeze. <br />There were no indications of any significant fishery in these two ponds prior to termination of <br />water pumping and mining activities. Therefore, this stipulation was terminated as part of the <br />midterm review process. <br />Stipulation #72 was attached to the permit renewed in June of 1994. It required on-the-ground <br />surveys to determine if structures existed over areas to be undermined. Since the need for this <br />survey no longer exists, this stipulation was terminated as part of the midterm review process. <br />Stipulation #73 was attached to the permit renewed in June of 1994. It required that an <br />Applicant Violator System "conditional issue" recommendation be resolved prior to August <br />30, 1994. The DMG database indicates a due date of September 23, 1994 for this stipulation, <br />which would indicate an extension of time to comply with this stipulation was granted when <br />-8- <br />
