C~ <br />J <br />The applicant has proposed a p~a`_-mica ~~~_i~g flan which ~dould be carried out <br />in compliance with recommendations contained in the Soil Conservation Service <br />(SCS) National Range Handbook, <br />Pursuant to Rule 2.07,6(2)(1), the Division approves the proposed post-mining <br />land uses of rangeland, pastureland and cropland. Based on information <br />contained in the reclamation plan and vegetation and wildlife monitoring <br />conducted by the applicant and the Division during the previous permit term on <br />reclaimed land and adjacent areas, the applicant has demonstrated that all <br />areas affected by surface coal mining operations can be restored to conditions <br />that are capable of supporting the proposed uses. The post-mining land uses <br />meet the requirements of Rule 4,16, <br />III. Cultural and Historic Resources - Rules 2,04,4, 2,05.6(4) and 2, 07,6(2)(e) <br />Information on cultural and historic resources is presented on pages 779-3 <br />through 779-7 and Map 5 of the C-81-071 permit document. <br />Rule 2.04,4 requires a description of the cultural and historic resources <br />listed on the National Register of Historic Places and known archaeological <br />features within all areas proposed for surface activities over the life of the <br />mine. A number of archaeological surveys have been conducted within the <br />current permit and proposed revision area, and they are detailed in the above <br />referenced permit sections. <br />The Colorado Regulations require that sites listed on the National Register of <br />Historic places be protected, The only such site within the permit area is <br />the restored Foidel Canyon Schoolhouse, located adjacent to Foidel Creek in <br />the northeast part of the permit area. The site will not be impacted by <br />proposed operations. <br />Consultation with Mr, Jim Green of the State Historical Preservation Office <br />(SHPO) has confirmed that the Foidel Canyon Schoolhouse is the only listed <br />site within the proposed permit area. <br />In order to insure compliance with Federal Regulations, the following three <br />stipulations have been included. <br />STIPULATION NO, 1 <br />IF, DURING MINING OPERATIONS, PREVIOUSLY UNIDENTIFIED CULTURAL RESOURCES <br />SHOULD BE DISCOVERED, THE OPERATOR SHALL IMMEDIATELY CEASE OPERATIONS WITHIN <br />THE VICINITY OF THE SITE AND NOTIFY THE REGULATORY AUTHORITY (MLRD). <br />OPERATIONS SHALL NOT RESUME UNTIL OSM, THE LAND MANAGING AGENCY, AND THE STATE <br />HISTORIC PRESERVATION OFFICER HAVE HAD ADEQUATE OPPORTUNITY TO ASSESS THE <br />CULTURAL RESOURCE. MINING OPERATIONS SHALL NOT RESUME UNTIL APPROPRIATE <br />MITIGATING MEASURES HAVE BEEN DEVELOPED, APPROVED BY THE DIVISION AND <br />IMPLEMENTED, <br />STIPULATION N0, 2 <br />NO LAND DISTURBING ACTIVITIES SHALL TAKE PLACE WITHIN 100 FEET OF THE TWO <br />KNOWN GRAVES ON THE PERMIT AREA, <br />1L <br />
