<br />1987, for manganese discharge levels in exceedance of UPDES permit limits. <br />Pl1rSUdnt t0 Rule 2.07,6(lj(b)(11 ~, itlf Jrmdti0^ hds beef iU biTi7 ~teQ :J uc <br />Division documenting that the applicant is presently pursuing, in good faith, <br />a direct administrative appeal. <br />Pursuant to Rule 2.07,6(2)(h), the Division finds that the applicant does not <br />control and has not controlled any mining operations with a demonstrated <br />pattern of willful violations of the Act of such nature, duration, and with <br />such resulting irreparable damage to the environment as to indicate an intent <br />not to comply with the provisions of the Act. <br />Pursuant to Rule 2.07.6(2)(f), the Division finds that operations will not <br />involve mining of private mineral estate (ail coal to be mined is Federally <br />owned coal leased to Cyprus and as such the documentation specified by Rule <br />2.03.6(2) does not apply). <br />Coal to be mined during this permit term is from Federal Leases C-26914, <br />C-081330, and C-22644, Affected surface lands are owned by Cyprus Western <br />Coal Company and the United States Government. <br />The operation is in compliance with the requirements of this section. <br />II. Land ~!se - Rules 2.04.3, 2.05.5 and 4.16 <br />Pre-mine land use information is provided on pages 779-301 through 779-377 and <br />Map 31 of the updated C-81-071 permit document. Post-mine land uses are <br />discussed on pages 780-201 through 780-208. <br />Areas to be mined in the next and succeeding permit terms within Eckman Park <br />are classified as rangeland and the reclamation plan would be directed towards <br />reestablishing rangeland which would support livestock grazing and provide <br />suitable habitat for various wildlife species. <br />Previously mined lands within the C-81-071 permit area include rangeland, <br />pastureland and cropland, with rangeland being the dominant land use <br />category, As shown on Map 31, pasturelands and croplands occur primarily <br />along Foidel Creek, the South Fork of Foidel Creek and in the vicinity of 14ine <br />2. Croplands historically consisted of winter wheat or alfalfa/grass <br />haylands, and pasturelands were planted to smooth brome or other forage <br />grasses. Rangeland has not been improved (with the exception of limited <br />acreage of sprayed sagebrush range) and supports numerous native vegetation <br />communities. Rangeland and pastureland was typically grazed by sheep or <br />cattle during spring, summer or fall, The reclamation plan calls for <br />restoring mined lands to rangeland, pastureland and cropland such that the <br />various land-use types occupy the same relative acreage as occurred prior to <br />mining. The proposed operations would not result in a reduction of long-range <br />productivity of food and fiber (primarily beef and wool) because the lands <br />will be reclaimed to their pre-mine land use and to the level of productivity <br />that they were capable of supporting before mining. <br />11 <br />
