<br />FINDIN(;5 OF THE <br /> <br />COLORADO MIMED LAND RECLAMATION DIVISION <br />FOR <br />THE ECKMAN PARK MINE COMPLEX <br />(Mine 1, Mine 2 and Eckman Park Renewal) <br />Explanation of Findings <br />Pursuant to Rule ?.07.6(2) of the Regulations of the Colorado Mined Land <br />Reclamation Board for Coal Mining, the tdined Land Reclamation Division or the <br />Board must make a number of written findings prior to the issuance of a permit <br />or permit revision approval. These findings are based on information made <br />available to the Division that demonstrates that the applicant will be able to <br />operate in compliance with the Colorado Surface Coal Mining Reclamation Act <br />and the regulations promulgated pursuant to the Act. <br />This findings document is organized according to the major disciplines <br />reviewed during the permitting process, The written findings which must be <br />made by the Division are addressed under the appropriate discipline subtitle, <br />For example, findings concerning t'•s ;:rotection of endangered or threatened <br />fish and wildlife species will he found under the subtitle of Fish and <br />!Vildlife. Also, any specific approvals required to he made by t~ie~ivision <br />pursuant to Rule 4 and thus requiring a written finding pursuant to rule <br />2,07,6(2)(m) are discussed under the appropriate discipline subtitle. <br />Legal, Financial and Compliance Information - Rule 2.03 <br />Legal, financial and compliance information is presented on pages 778-1-1 <br />through 778-33-1 of the updated C-81-011 permit document. <br />The legal and financial sections of the existing permit required substantial <br />revision as a result of a 1985 permit transfer in which Cyprus Western Coal <br />Equipment Company (Cyprus) acquired Colorado Yampa Coal Company (CYCC), CYCC <br />is a wholly owned subsidiary of Cyprus, Other coal companies controlled in <br />whole or in part by Cyprus are Twentymile Coal Company which holds Colorado <br />Coal Permits C-82-056 (Foidel Creek Underground Mine) and C-81-036 (Fish Creek <br />Tipple), and Plateau Mining Company, which holds Utah Permit No, ACT/007/006, <br />In addition to Permit C-81-071, CYCC also holds Permit C-84-062 for Mine Nn. <br />3, a reclaimed surface mine located several miles to the northeast of the <br />Eckman Park Mine Complex, <br />Pursuant to Rule 2.07.6(2)(9), the Division finds that the applicant does not <br />own or control any operations which are currently in violation of any law, <br />rule, or regulation of the United States, or any state law, rule or regulation <br />enacted pursuant to Federal Law, pertaining to air or water environmental <br />protection or any provision of the Surface Mining Control and Reclamation Act <br />or the Colorado Surface Coal tiining Reclamation Act, with the exception of one <br />notice of violation issued by the Colorado Department of Health on July 17, <br />10 <br />
