Shirley Lindsay, Office of Surface Mining, <br />Reclamation and Enforcement, Denver, CO <br />Energy Project Leader, USFIJS, Colorado Field Office, <br />Lakewood, CO <br />Establishing of a Buffer Area around a Prairie Falcon Nest <br />Close to the Utah International Lease Boundary <br />As we addressed in our letter dated August 5, 1782, o-re located a prairie <br />falcon aerie within a quarter mile of the lease boundary. 41e: believe <br />it is important to establish a buffer zone around the nest to protect <br />it. The huffer zone that we have delineated was drawn from the quad <br />sheet on legal boundaries to make it easily identifiable. We have also <br />included a map for reference. The legal description is as follows: <br />• Range 91 West, Township 51J, S'z of SE'„ of Section 5, <br />NE'; of Section 8, NW%, of Section 9, SW's of SW; of <br />Section 4 <br />All surface activity should be avoided within this area during the critical <br />period for nesting P1arch 1 through July 31st. <br />Besides this prairie falcon, there were several Golden Eagles located on <br />or within close proximity to the lease boundary. These nests were all <br />noted in the applicant's mine plan and therefore we believe the applicant <br />has taken measures to protect these nests. At this time we are not aware <br />of any federally endangered species use on the lease tract. <br />Ole appreciate the opportunity to comment on the mine plan and to delineate <br />a buffer zone around the prairie falcon aerie.
