~ 1 <br />Mid-Term Review <br />19 November 27, 1985 <br />The initial Mid-Term review letter for the Deserado Mine indicated that the <br />requirements of this stipulation had been satisfied. However, no specific <br />revegetation success criteria for species diversity could be located on page <br />V-51a of the application. This page must be revised to state, for each <br />affected plant community, the specific species diversity success standard <br />proposed by the Division in a letter to Western Fuels dated April 1, 1982. <br />The standard calls for 2 cool season grasses and one forb to be established, <br />with each species to contribute greater than 3% relative cover. This standard <br />applies to both lowland and upland seed mixes. <br />(Part 2) <br />WITH RESPECT TO THE USE OF REFERENCE AREAS AND RANGE SITE DESCRIPTIONS IN <br />DETERMINATION OF REVEGETATION SUCCESS, THE PROCEDURES OUTLINED IN COMMENT 5 OF <br />THE APRIL 20, 1981 LETTER TO WESTERN FUELS ARE TO BE FOLLOWED. POOR CONDITION <br />REFERENCE AREAS ARE TO BE FENCED. IF A CONDITION CHECK AT THE TIME OF BOND <br />RELEASE INDICATES THAT THE REFERENCE AREA IS STILL IN POOR CONDITION, <br />ALTERNATIVE SUCCESS STANDARDS WILL BE SET BY THE REGULATORY AUTHORITY. <br />CONDITION CHECKS AT THE TIME OF REQUESTED BOND RELEASE ARE TO INCLUDE SHRUB, <br />AS WELL AS HERBACEOUS, PRODUCTION. SECTION D ON PAGE V-51, SECTION E ON PAGE <br />V-51 a, AND SECTION E ON PAGE V-53 SHALL BE REVISED ACCORDINGLY. <br />The Division's initial February 7, 1984 midterm review letter for the Deserado <br />mine indicated that the requirements of this stipulation had been satisfied, <br />however it appears that none of the revised pages have been inserted into the <br />permit application. To properly resolve this stipulation, Western Fuels <br />should provide a statement on the above indicated pages committing to <br />conducting an evaluation of the range condition of each of the reference areas <br />at the time of bond release. The range Condition evaluation will involve <br />measuring both herbaceous and woody plant production. Western Fuels should <br />further commit to developing an alternative set of revegetation success <br />standards in consultation with the Division if the range evaluation results <br />indicate a poor range condition. <br />Stipulation No. 20 <br />WESTERN FUELS MUST BE SUBMIT, FOR THE REGULATORY AUTHORITY APPROVAL, A <br />DETAILED SAMPLING PLAN INCORPORATING THE REQUESTED CHANGES IN PLOT SIZE AND <br />TRANSECT DESIGN. THIS PLAN MUST BE SUBMITTED PRIOR TO THE COMMENCEMENT OF <br />SAMPLING FOR 1981. <br />An approved vegetation sampling program was undertaken during the summer of <br />1981. Therefore, the requirements of Stipulation No. 20 have been satisfied. <br />Stipulation No. 21 <br />ATRIPLEX CONFERTIFOLIA MUST BE REMOVED FROM THE PROPOSED SEEDMIXES AND <br />REPLACED BY ATRIPLEX CANESCENS. IN ADDITION, COLORADO WILDRYE WILL BE <br />SUBSTITUTED FOR BLUEBUNCH WHEATGRASS. THE REVISED SEEDMIXES MUST BE SUPPLIED <br />TO THE REGULATORY AUTHORITY WITH 30 DAYS OF APPROVAL. <br />
