~ 1 <br />Mid-Term Review 18 November 27, 1985 <br />Stipulation No. 17 <br />WITH RESPECT TO VEGETATION SAMPLING DURING THE 1981 FIELD SEASON IN AREAS TO <br />BE DISTURBED BY REFUSE DISPOSAL UNITS 1-4, THE NUMBER OF SAMPLE CLUSTERS <br />WITHIN EACH VEGETATION TYPE SHALL BE AS SPECIFIED ON PAGE 24-7 OF ILLUSTRATION <br />24. CORRESPONDING REFERENCE AREAS MUST ALSO BE SAMPLED FOR APPLICABLE <br />PARAMETERS. THE SIZE AND LOCATION OF PROPOSED REFERENCE SITES MUST BE <br />SUBMITTED TO THE REGULATORY AUTHORITY WITHIN 30 DAYS OF APPROVAL. THE <br />REFERENCE AREA WHICH WILL REPRESENT THE AREA PRESENTLY OCCUPIED BY THE <br />CHEATGRASS-ANNUAL FORB COMMUNITY MUST BE SPECIFIED. <br />The requirements of this stipulation have been satisfied, however a review of <br />vegetation Maps 9 and 10 reveal that the size and location of the reference <br />areas have not been depicted on either of the maps. Both maps must be revised <br />to show the reference areas to be used for determination of revegetation <br />success. Additionally, the Division can find no information in the permit <br />specifying which reference area will be used to represent the area presently <br />occupied by the cheatgrass-annual forb community. The reclamation plan <br />portion must be revised to provide this information. the revised copy of <br />Illustration 24, Tables V-12, V-13, V-14 and V-16, and replacement pages V-40, <br />V-41, V-43 and V-63 submitted to the Division on July 30, 1981 in response to <br />the above stipulation need to be incorporated into the permit application. <br />Stipulation No. 18 <br />DISTURBED ACREAGES OF EACH VEGETATION TYPE AFFECTED BY THE SITES MENTIONED ON <br />PAGE 24-8 SHALL BE CALCULATED AND SUBMITTED TO THE REGULATORY AUTHORITY WITHIN <br />30 DAYS OF APPROVAL. THE NUMBER OF SAMPLE CLUSTERS REQUIRED WILL BE SET BY <br />THE REGULATORY AUTHORITY AT THAT TIME. A MAP INDICATING THE SIZE AND LOCATION <br />OF PROPOSED REFERENCE SITES SHALL ALSO BE SUBMITTED BY THE ABOVE DEADLINE. <br />The initial midterm review letter sent to Western Fuels on February 7, 1984 <br />indicates that the requirements of this stipulation have been satisfied. <br />However, no disturbed acreages of each vegetation type affected by the sites <br />mentioned on page 8 of Illustration 24 could be found in Section V of the <br />application or within Illustration 24 of Volume 12 of the application. An <br />appropriate section of the application needs to be revised to provide this <br />information. Please refer to the comments under Stipulation No. 17 above <br />regarding the size and location of reference areas. <br />Stipulation No. 19 (Part 1) <br />WITH RESPECT TO EVALUATION OF SPECIES DIVERSITY ON RECLAIMED LANDS, WESTERN <br />FUELS IS REQUIRED TO WORK WITH THE REGULATORY AUTHORITY TOWARDS THE <br />ESTABLISHMENT OF MUTUALLY ACCEPTABLE SUCCESS CRITERIA. SUCH CRITERIA MUST BE <br />FORMULATED AND AGREED TO NO LATER THAN JANUARY 1, 1982. SECTION F ON PAGE <br />V-51a SHALL BE REVISED ACCORDINGLY. <br />
