<br />1 <br />Mid-Term Review 17 November 27, 1985 <br />(g) TO COMPLY WITH TEMPORARY CESSATION REGULATIONS (RULE 4.30.1). <br />The requirements of items a, b, c, e, f and g of this stipulation have been <br />satisfied as described below. Item d requires an additional response as noted <br />below. <br />(a) Sediment control measures were implemented prior to the onset of <br />construction of the coal transport and storage area; <br />(b) Emergency and principal spillway outlets with appropriate erosion control <br />were provided prior to the construction of sediment ponds; <br />(c) Baffles were provided on each of the two refuse disposal area sediment <br />ponds; <br />(d) Rule 4.05.9(8) regards professional certification requirements for <br />impoundments. All impoundments presently permitted at the mine have been <br />certified in one form or another following construction and are contained <br />within the Division's professional certification file. However, in order to <br />reflect the certified as-built status of the eight Deserado Mine impoundments <br />within the permit application itself the Division requests that all maps and <br />drawings of the ponds presently within the application be amended and stamped <br />as necessary to show the as-built configuration of each impoundment. <br />(e) This portion of Stipulation No. 15 regards an existing statutory <br />notification requirement (Rule 4.05.13(2)(a)(ii)). As such, a separate <br />commitment by Western Fuels to comply is unnecessary. This portion of <br />Stipulation No. 15 is therefore considered resolved. <br />(f) Revegetation of the alluvial well field access road topsoil stockpile has <br />been accomplished. <br />(g) As with item (e) above, this portion of Stipulation No. 15 regards an' <br />existing statutory requirement (Rule 4.30) which does not require a separate <br />commitment to comply by Western Fuels. As such, this portion of Stipulation <br />No. 15 is considered resolved. <br />Stipulation No. 16 <br />WITH RESPECT TO VEGETATION RESAMPLING IN THE 1981 FIELD SEASON, SITE 50 <br />(COLORADO WILDRYE) AND ITS REFERENCE AREA WILL BE SAMPLED FOR HERBACEOUS COVER <br />AND PRODUCTION. SITE 60 (JUNIPER) WILL BE SAMPLED FOR SHRUB DENSITY AND FOR <br />PRODUCTION. SITE 41 (SAGEBRUSH-GRASS) AND SITE 40 (GREASEWOOD-SAGEBRUSH) AND <br />CORRESPONDING REFERENCE SITES WILL BE SAMPLED FOR PRODUCTION. DATA SUMMARIES <br />AND STATISTICAL ANALYSES MUST BE SUBMITTED TO THE REGULATORY AUTHORITY BY <br />OCTOBER 1, 1981. THIS SHALL APPLY FOR ALL SAMPLING CONDUCTED DURING 1981. <br />The requirements of this stipulation have been satisfied. It appears that all <br />of the sampling results and statistical analyses have been incorporated into <br />the permit application (February 16, 1983 submittal), therefore no additional <br />response is required. <br />
