<br />1 <br />Mid-Term Review 20 November 27, 1985 <br />Tables V-13 and V-14 within Volume 4 of the Division copies of the application <br />have not be revised to delete shadscale (Atriplex confertifolia) and to <br />replace bluebunch wheatgrass with Colorado Wildrye. Pages V-39a, V-40 and <br />V-41 need to be revised in the same fashion. Once the revised tables and <br />pages have been incorporated into the permit, Stipulation No. 21 can be <br />considered resolved. <br />Stipulation No. 22 <br />WITHIN 30 DAYS AFTER THE PERMIT HAS BEEN GRANTED, THE APPLICANT MUST PROVIDE <br />THE FOLLOWING INFORMATION TO THE REGULATORY AUTHORITY: <br />(a) SPECIFICATIONS AND CALCULATIONS SHOWING THAT DITCHES ALONG THE IMPROVED <br />SECTION OF COUNTY ROAD 65, THE MINOR ACCESS ROADS, AND THE CONVEYOR <br />MAINTENANCE ROAD HAVE BEEN DESIGNED TO WITHSTAND THE 10 YEAR-24 HOUR STORM <br />EVENT; <br />(b) DEMONSTRATE THAT THE CONVEYOR MAINTENANCE ROAD EMBANKMENT OVER CROSSINGS <br />OF TRIBUTARIES TO RED WASH IS ADEQUATELY PROTECTED FROM EROSION AND FILL <br />SATURATION DURING A 10 YEAR-24HOUR FLOOD EVENT; <br />(c) DESIGNS SHOWING THAT DRAINAGE WILL BE PROPERLY CONTROLLED AT STATION <br />7-45.93 OF THE COUNTY ROAD 65; <br />(d) IDENTIFY THE ORIGIN OF ROAD SURFACING MATERIAL AND WHETHER OR NOT IT HAS <br />BEEN SHOWN TO BE NON-TOXIC AND NON-ACID FORMING; <br />(e) ASSURE THE RIO BLANCO COUNTY ROAD DEPARTMENT THAT THERE WILL BE NO <br />LEFT-HANDED TRAFFIC ON COUNTY ROAD 78; AND <br />(f) SHOW THAT THE REFUSE AREA WILL NOT BE LOCATED LESS THAN 100 FEET FROM <br />COUNTY ROAD 78. <br />The status of resolution of items (a) through (f) of Stipulation No. 22 are as <br />follows: <br />a. The Divisions' February 7, 1984 letter to Western Fuels regarding the <br />Deserado Mine stipulations requested that cross drain culvert specifications <br />for the improved portions of County Road 65 be submitted, as well as a map <br />showing the watershed acreage above each culvert and set of supporting <br />calculations for the County Road 65 culvert of station 29+00. Western Fuels <br />adequately responded to these requests by submitting a copy of Illustration 2 <br />and Maps 57-58 of the application showing sizing calculations and <br />configurations of the culverts. A copy of Western Fuels work map was also <br />submitted showing the watershed acreage above each culvert. Additionally, a <br />copy of Illustration 27 of the permit was submitted to show the sizing <br />calculations for the County Road 65 culvert at station 29+00. Based on a <br />review of this information, the Division concurs that ditches along the <br />improved section of County Road 65, the minor access roads, and the conveyor <br />maintenance road have been designed to withstand the 10 year-24 hour storm <br />event. As such, item (a) of Stipulation No. 22 is considered resolved. <br />
