~ 1 <br />Mid-Term Review 15 November 27, 1985 <br />Stipulation No. ll <br />WITHIN 60 DAYS OF APPROVAL OF THE MINING PERMIT, THE APPLICATION SHALL PROVIDE <br />DITCH DIMENSIONS FOR THE ENTIRE "NORTH TOPSOIL DITCH" IN THE D-PORTAL AREA. <br />THESE PLANS MUST BE SUBMITTED AND APPROVED PRIOR TO THE ONSET OF CONSTRUCTION <br />AT THE D-PORTAL AREA. <br />Information within the Division files indicates that an adequate response to <br />this stipulation was received by the Division within the required time frame, <br />thereby resolving the stipulation. However, the actual ditch designs could not <br />be located in the permit application. The Division requests that copies of <br />the revised ditch designs be submitted to the Division for inclusion into the <br />Deserado permit application. <br />~_Stipulation No. 12 <br />WITHIN 60 DAYS OF APPROVAL OF THE PIINING PERMIT, THE APPLICANT MUST SUBMIT THE <br />CALCULATIONS AND ASSUMPTIONS USED TO SIZE THE RAILROAD LOOP SEDIMENTATION <br />PONDS, AND MUST RESIZE THE OUTLET CULVERT AS SEDIMENTATION POND #4 IN THE <br />RAILROAD LOOP TO PREVENT EXCESSIVE PONDING AT THE ENTRANCE OR JUSTIFY THE <br />PRESENT SIZING WITH APPROPRIATE CALCULATIONS. THE LOWER SEGMENT OF THE <br />SUBAREA R4 REFUSE DITCH MUST ALSO BE RESIZED TO ACCOMMODATE THE 10 YEAR-24 <br />HOUR FLOW. THIS MUST BE COMPLETED AND PLANS APPROVED BY THE REGULATORY <br />AUTHORITIES PRIOR TO THE ONSET OF WORK AT THE RAILROAD LOOP. <br />The Division received and subsequently approved the revised calculations and <br />drainage control structures referenced in the above stipulation. Therefore, <br />Stipulation No. 12 is considered resolved. However, a review of the permit <br />application indicates that the revised illustrations (Numbers 29 through 35) <br />have not been incorporated into the permit application. During the process of <br />physically updating Division copies of the application, the revised <br />illustrations will need to be inserted into the application. <br />Stipulation No. 13 <br />THE APPLICANT SHALL SUBMIT THE REGULATORY AUTHORITY WITHIN 90 DAYS A MODIFIED <br />RESTORATION PLAN FOR SCULLION GULCH TO OMIT THE THIRTEEN PROPOSED IN-CHANNEL <br />ROCK CHECK DAMS. IN LIEU OF THESE, THE APPLICANT SHALL INSTALL THREE DAMS OR <br />SEDIMENT TRAPS, BUILT TO SCS OR U.S. FOREST SERVICE SPECIFICATIONS, AT THE <br />DOWNSTREAM CONSTRUCTION LIMITS IN SCULLION GULCH. THESE TRAPS SHOULD PROVIDE <br />SUFFICIENT STORAGE TO STORE ONE YEAR OF SEDIMENT ACCUMULATION FROM D-PORTAL <br />AREA. THE TRAPS MUST BE INSTALLED PRIOR TO THE ONSET OF RECLAMATION, CLEANED <br />PERIODICALLY THROUGHOUT THE RECLAMATION PERIOD AND REMOVED WHEN THE <br />APPROPRIATE REGULATORY AUTHORITY HAS DEEMED THE RECLAMATION PROCESS <br />EFFECTIVE. MODIFIED RESTORATION PLANS REFLECTING THE ABOVE STIPULATIONS MUST <br />BE SUBMITTED TO THE REGULATORY AUTHORITY WITHIN 90 DAYS OF PERMIT APPROVAL. <br />A plan was received by the Division on October 23, 1981 consisting of a <br />revised copy of Illustration 22 (sheets 1, 3, and 12 only) showing the <br />proposed check dam dimensions and sizing calculations and one set of revised <br />
