~ ~ <br />Mid-Term Review 14 November 27, 1985 <br />Stipulation No. 8 <br />PRIOR TO THE DEVELOPMENT OF MAINS AND SUB-MAINS BENEATH THE ALLUVIAL BODY OF <br />RED WASH, THE APPLICANT MUST SUBMIT THE INFORMATION REQUIRED BY SECTION 2.06.8 <br />(4) OF THE COLORADO REGULATORY PROGRAM, ALONG WITH A PLAN TO ENSURE THAT THE <br />PERFORMANCE STANDARDS AND MONITORING REQUIREMENTS OF SECTION 4.24 ARE MET. <br />THIS PLAN MUST ADDRESS THE ANALYSIS OF SUBSIDENCE MONITORING DATA COLLECTED TO <br />DATE. MINING BENEATH THE ALLUVIUM OF RED WASH SHALL NOT COMMENCE UNTIL THE <br />SUBMITTALS ARE APPROVED BY THE REGULATORY AUTHORITY. IT IS ALSO RECOMMENDED <br />THAT THE APPLICANT MEET IN ADVANCE WITH HE REGULATORY AUTHORITY REGARDING THE <br />PLANNING OF THE STUDIES REQUIRED BY SECTION 2.06.8(4). <br />The Division received a copy of the "Red Wash Drainage Basin Alluvial Valley <br />Floor Study" for the Deserado Mine on July 27, 1983. Based on a review of <br />this information, the Division made a negative AVF Determination for the Red <br />Wash Alluvial body and revised the findings document accordingly during <br />October of 1983. However, Western Fuels must submit an analysis of subsidence <br />monitoring data prior to mining beneath the alluvium of Red Wash. <br />Stipulation No. 9 <br />THE APPLICANT MUST ALSO SUBMIT, AS PART OF THE PERMIT APPLICATION, WRITTEN <br />DOCUMENTATION AS TO THE NATURE OF THE REGIONAL IRRIGATION INVENTORY <br />PERFORMED. THIS DOCUMENTATION MUST ADDRESS THE DEFICIENCIES OUTLINED IN <br />SECTION C OF THIS TEA, SO THAT THE AVF DETERMINATION FOR SCULLION GULCH CAN BE <br />ADEQUATELY SUBSTANTIATED. THE INFORMATION SHOULD BE SUBMITTED WITHIN 30 DAYS <br />OF THE GRANTING OF THE PERMIT. <br />A letter indicating that this stipulation had been resolved was forwarded to <br />the Division on June 24, 1981 (letter dated June 22, 1981). Upon review of <br />the Deserado findings document,it appears that the actual documentation was to <br />take the form of a letter from Mr. Alvin Jones of the SCS -Meeker area office <br />to the Division which documents local irrigation conditions. A detailed <br />review of the OSM findings document (page 10, AVF section) reveals, however <br />that sufficient documentation was already in existence in the form of a <br />published SCS report entitled "Important Farmland Inventory - Colorado" dated <br />September, 1980 which includes maps of Rio Blanco County. As such, <br />Stipulation No. 9 is considered resolved. The requested written documentation <br />from Mr. Alvin Jones was received by the Division and is contained within the <br />Deserado Mine file. <br />Stipulation No. 10 <br />THE APPLICANT SHALL PROVIDE THE REGULATORY AUTHORITY WITH A CORRECTED VERSION <br />OF MAP 77, REFUSE DISPOSAL AREA SITE PREPARATION WHICH SHOWS THE LOCATION OF <br />THE CULVERT THAT CARRIES FLOW FROM THE NON-TOXIC FILL STOCKPILE DITCH ACROSS <br />THE HAUL ROAD INTO THE SUBAREA RP2-3 SEDIMENT POND. THIS INFORMATION SHOULD <br />BE SUBMITTED WITHIN 90 DAYS OF APPROVAL OF THE MINE PLAN PERMIT. <br />A corrected version of Map 77, (2 copies of Revision 1 of the map) was <br />submitted to the Division on October 23, 1981. Stipulation No. 10 is <br />therefore considered resolved. <br />
