<br />1 <br />Mid-Term Review 13 November 27, 1985 <br />Western Fuels has submitted the overburden analyses as an amended report <br />inserted at the end of the Geology Report, Section II.B. of the permit <br />application. This stipulation is therefore considered resolved. The Division <br />requests, however that 3 additional copies of this information be submitted <br />for inclusion into the permit applications currently on file at the Division. <br />Stipulation No. 6 <br />THE APPLICANT MUST SUBMIT A MONITORING PLAN FOR THE WHITE RIVER ALLUVIUM TO <br />ENSURE THAT DRAWDOWN PROJECTIONS ARE NO LARGER THAN ANTICIPATED, AND THAT THE <br />MONITORING OBJECTIVES OF SECTION 4.24.5 OF THE COLORADO PERMANENT REGULATORY <br />PROGRAM ARE MET. THIS INFORMATION MUST BE SUBMITTED TO THE REGULATORY <br />AUTHORITY WITHIN 90 DAYS OF THE GRANTING OF THE PERMIT. <br />A monitoring plan was received on October 23, 1981. Revisions to the approved <br />monitoring plan were approved by the Division on August 12, 1982 and October <br />4, 1984. At present, the following plan is in effect for monitoring the White <br />River Alluvium utilizing the monitoring wells depicted on Map 90, Revision <br />No. 2: <br />Water levels in monitoring wells QAL-1, 2, 3, 4, 5 and 6 completed in <br />the White River alluvium will be monitored on a monthly basis to obtain <br />data on water levels, pH, specific conductivity, and temperature. A <br />full suite analysis of each well will be conducted quarterly. Data <br />from these wells will be provided to the Mined Land Reclamation <br />Division on a quarterly basis. <br />This monitoring program needs to be incorporated into the appropriate section <br />of the approved permit application. Three copies of Map 90 -Revision No. 2 <br />must be submitted to replace outdated maps presently on file. <br />Stipulation No. 7 <br />THE APPLICANT MUST ALSO COMMIT TO PROVIDING A MITIGATION PLAN SHOULD THE <br />EFFECTS OF DRAWDOWN IN THE WHITE RIVER ALLUVIAL AQUIFER DETRIMENTALLY EFFECT <br />ESTABLISHED AGRICULTURAL ACTIVITIES, EITHER THROUGH UNFORESEEN IMPACTS OR FROM <br />GROUNDWATER DEPLETIONS WHICH ARE LARGER THAN EXPECTED. <br />Based on a review of the Division files and the approved permit application, <br />it does not appear that a response to this stipulation was ever received by <br />the Division. As such, Western Fuels must revise the permit application to <br />include a commitment to provide a mitigation plan for downstream water users <br />in the event that drawdown in the White River Alluvial Aquifer detrimentally <br />effects established agricultural activities, either through unforeseen impacts <br />or from groundwater depletions which are larger than expected. Western Fuels <br />may wish to modify this commitment, however, in light of the presence of <br />Taylor Draw Reservoir which has drastically affected the recharge <br />characteristics of the White River alluvium. <br />
