~ 1 <br />Mid-Term Review 12 November 27, 1985 <br />Revised Stipulation No. 2 <br />UPON COMPLETION OF PRODUCTION MINING WITHIN ROOM AND PILLAR PANEL RP-5 AND <br />LONGWALL PANEL LW-1 THE APPLICANT SHALL PREPARE ANALYSIS OF THE SUBSIDENCE <br />MONITORING DATA COLLECTED TO THAT DATE. NO PRODUCTION MINING SHALL BE <br />COMMENCED WITHIN ANY ADDITIONAL PANELS UNTIL THAT REPORT HAS BEEN REVIEWED AND <br />APPROVE6 BY THE REGULATORY AUTHORITY. IF THE RESULTS OF THAT ANALYSIS <br />DETERMINE THAT A REVISION OF THE MINING PLAN FOR THE REMAINDER OF THE MINE IS <br />APPROPRIATE, THE APPLICANT SHALL COMPLETE THE APPROPRIATE REVISIONS AND SUBMIT <br />THEM TO THE REGULATORY AUTHORITY FOR REVIEW. NO PRODUCTION MINING SHALL BE <br />COMMENCED WITHIN ANY ADDITIONAL PANELS OF THE MINE UNTIL THAT REVISION HAS <br />BEEN APPROVED BY THE REGULATORY AUTHORITY. <br />Stipulation No. 3 <br />NO SUBAREA OF THE REFUSE DISPOSAL AREA SHALL BE DISTURBED BY MINING ACTIVITIES <br />UNTIL THE APPLICANT HAS DEMONSTRATED TO THE REGULATORY AUTHORITIES' <br />SATISFACTION THAT SUFFICIENT NON-TOXIC MATERIAL IS AVAILABLE TO COMPLY WITH <br />RULE 4.10. <br />This stipulation has been satisfied. However, the Division requests that <br />Western Fuels submit the information supplied to the Division on June 22, 1981 <br />regarding this demonstration in the form of revised pages to Section V.B. and <br />Section V.H. of the permit application to describe the availability of four <br />feet of non-toxic, non-combustible fill material for use as cover over the <br />refuse disposal areas. Additionally, a separate demonstration must be made by <br />Western Fuels for refuse subareas 2 and 3 and submitted to the Division in the <br />form of revised pages to the permit application. <br />Stipulation No. 4 <br />A PLAN MUST BE SUBMITTED TO THE REGULATORY AUTHORITY WITHIN 30 DAYS OF <br />APPROVAL OF THIS MINE PLAN FOR THE HANDLING AND DISPOSAL OF MATERIAL IN THE <br />"STORAGE AREA" AND A POST-MINING TOPOGRAPHIC MAP OF THE RAILROAD STORAGE AND <br />LOAD OUT AREAS. <br />Based on a review of the Division files and the approved permit application, <br />no "storage area" material handling and disposal plan could be located. <br />Western Fuels needs to revise the permit application to include a reclamation <br />plan for the railroad storage and loadout area. Post-mining topographic maps <br />of the railroatl loadout and slot storage areas were submitted to the Division <br />on July 15, 1985. Three additional copies of these two maps (Numbers 104 and <br />105) must be submitted for inclusion into the Division's copies of the <br />Permit. An as-built map of the entire slot storage area, including sediment <br />control structures, must also be submitted. <br />Stipulation No. 5 <br />THE APPLICANT WILL INCORPORATE OVERBURDEN ANALYSIS SUBMITTED TO THE REGULATORY <br />AUTHORITY ON MAY 29, 1981, INTO THE MINE PLAN WITHIN 30 DAYS OF APPROVAL OF <br />THE PERMIT. <br />
