<br />1 <br />Mid-Term Review 11 November 27, 1985 <br />Section III - Status of Stipulations <br />The following section details the status of resolution of the 34 stipulations <br />attached to Permit No. C-81-018 and describes what additional responses or <br />revisions to the permit will be necessary to fully resolve the stipulations <br />and bring the permit application up to date. <br />Stipulation No. 1 <br />PRIOR TO ISSUANCE OF A PERMIT TO CONDUCT MINING OPERATIONS, THE APPLICANT MUST: <br />(a) SUBMIT A PERFORMANCE BOND PAYABLE TO THE STATE AND THE U.S. GOVERNMENT IN <br />AN AMOUNT CONSISTENT WITH THE REQUIREMENTS OF (b) BELOW AND THE RECLAMATION <br />COST ESTIMATES CONTAINED IN THE APPLICATION. <br />(b) SUBMIT A MAP SHOWING EACH AREA OR LAND ON THE PROPOSED PERMIT AREA FOR <br />WHICH A PERFORMANCE BOND WILL BE SUBMITTED, SUBMIT A DESCRIPTION OF ACTIVITIES <br />TO OCCUR ON THOSE AREAS OF LAND, AND IDENTIFY THE AMOUNT OF PERFORMANCE BOND <br />TO COVER RECLAMATION COSTS ASSOCIATED WITH EACH AREA OF LAND. <br />The requirements of this stipulation have been satisfied with the acceptance <br />by the Division of a performance bond in the amount of $6,000,000.00 <br />(submitted incrementally). Items requested under 1 (b) are presently <br />contained within the approved permit application. The current bond amount may <br />be adjusted, however as part of the midterm review process. <br />Stipulation No. 2 <br />UPON COMPLETION OF PRODUCTION MINING WITHIN THE EASTERN MOST PORTION OF ROOM <br />AND PILLAR PANEL R.P.I-D AND THE EASTERN HALF OF LONGWALL PANEL L.W.D.-1, THE <br />APPLICANT SHALL PREPARE ANALYSIS OF THE SUBSIDENCE MONITORING DATA COLLECTED <br />TO THAT DATE. NO PRODUCTION MINING SHALL BE COMMENCED WITHIN ANY ADDITIONAL <br />PANELS UNTIL THAT REPORT HAS BEEN REVIEWED AND APPROVED BY THE REGULATORY <br />AUTHORITY. IF THE RESULTS OF THAT ANALYSIS DETERMINE THAT A REVISION OF THE <br />MINING PLAN FOR THE REMAINDER OF THE MINE IS APPROPRIATE, THE APPLICANT SHALL <br />COMPLETE THE APPROPRIATE REVISIONS AND SUBMIT THEM TO THE REGULATORY AUTHORITY <br />FOR REUIEW. NO PRODUCTION MINING SHALL BE COMMENCED WITHIN ANY ADDITIONAL <br />PANELS OF THE MINE UNTIL THAT REVISION HAS BEEN APPROVED BY THE REGULATORY <br />AUTHORITY. <br />Based on information contained in the permit application and the Division <br />files, it appears that mining has not progressed into the above referenced <br />areas. Additionally, the current proposed D-seam Mine Plan depicted on Plate <br />7 of the L.M.U. and R2P2 plan submitted to the B.L.M. differs substantially <br />from the original mine plan which generated the requirements of Stipulation <br />No. 2. As such, Stipulation No. 2 is still in effect and is hereby revised to <br />account for revisions to the original mine plan approved by the Division <br />subsequent to permanent program permit issuance: <br />
