As long <br />as slides from these cut areas do raot present a potential for serious <br />environmental harm and have not demonstrated instability in the past, and _ <br />because the applicant is required to maintain ditches and roads these <br />excessive slopes are permissable and meet the requirements of Rule 4.03.1 <br />All other aspects of road design at the McClane Canyon site are in conformance <br />with these sections of the Rules and Regulations. <br />XIX. Bonding-Rule 2.05.4(2)(b) and Rule 3 <br />Salt Creek Mining Company has agreed to past a performance bond in the amount <br />of The Division has determined that this arm unt will be <br />sufficient to cover the cost of reclamation at the McClane Canyon Mine. <br />Pursuant to Rules 2.07.6(2)(j) and 3.02.1(1), the performance bond in this <br />ammunt will be filed with the Division, payable to the State of Colorado, <br />before a permit will be issued. <br />XX. Sealing of Drill Holes s Underground Openings-Rules 2.05.4(2)(8) and <br />4.07 <br />The appropriate information satisfying these requirements appear in Sections" <br />2.1 and 3.7 of the application (Volume I). The applicant has committed to <br />conform with all the applicable regulations regarding the sealing and <br />management of borings. <br />The portal sealing methods are also consistent with the appropriate Rules <br />and Regulations. <br />XXI. Subsidence-Rules 2.05.6(6), and 4.20 <br />Subsidence information is included in Section 2.1.9 of the application. <br />Information provided in the application indicated the absence of renewable <br />resource lands or structures in the permit and adjacent areas which would <br />be adversly affected by subsidence over the mine workings. Since renewable <br />resource lands or structures will not be adversely affected by subsidence, <br />no subsidence monitoring is necessary. <br />The operation is in compliance with the requirements of this section. <br />XXII. Miscellaneous Compliance-Rules 2.05.6(5), 4.02, 4.12, 9.19, 4 <br />The Zoadout/tipple facilities for the proposed operation is not located at <br />the mine site. This facility is shared with and permitted in conjunction <br />with another mining operation, Munger Canyon, which is also owned by Salt <br />Creek Mining Company. <br />
