<br />24 <br />XIX. Roads - Rules 2.05.3(3) and 4.03 <br />The Roads Section in Volume I, Section 4, and the Road Drainage Section in <br />Vo]ume VI of the application were reviewed for compliance. <br />The applicant proposes to construct an access road to the surface facilities <br />which will be temporarily used as a haul road until the proposed railroad is <br />constructed; a haul road from the surface facilities area to the coal refuse <br />embankments; and several light use roads along the pipeline corridors <br />transmission line corridor; and monitoring sites. <br />The applicant proposes to retain the access and haul roads as part of the <br />post-mining land use. In accordance with Ru]e 4.03(1)(f), retention of the <br />roads can be approved by the Division if the landowner requests that the road <br />be left. Therefore, the following information is necessary: <br />Requirement No. 9 <br />PRIOR TO APPROVAL OF THE NAUL ROAD AND/OR ACCESS ROAD, THE APPLICANT <br />MUST EITHER: 1) REVISE THE APPROVED APPLICATION WITH A WRITTEN <br />REQUEST FROM THE LANDOWNERS(S) THAT THE ROADS OR CERTAIN PARTS THEREOF <br />ARE TO BE LEFT OPEN FOR FURTHER USE: OR 2) REVISE THE APPROVED PERMIT <br />APPLICATION WITH A DETAILED RECLAMATION PLAN FOR THE ROADS. <br />Since the access road is to be temporarily used as a haul road, it must meet <br />the standards of Rule 4.03.1 as a haul road. This includes certification that <br />the road has been constructed as designed. The applicant has not committed to <br />certification of either the haul road or the access road; therefore, the <br />following stipulation is necessary: <br />Stipulation No. 9 <br />IMMEDIATELY FOLLOWING CONSTRUCTION, THE PERMITTEE MUST SUBMIT A <br />STATEMENT BY A REGISTERED PROFESSIONAL ENGINEER CERTIFYING THAT THE <br />HAUL ROAD AND THE ACCESS ROAD, WHICH WILL TEMPORARILY BE USED AS A HAUL <br />ROAD, NAVE BEEN CONSTRUCTED AS DESIGNED. <br />The designs of the haul road and access road meet all the requirements of Rule <br />4.03.1 for drainage, grade, road cuts, and road embankments, with one <br />exception. The applicant has not completed a structural and foundation <br />analysis to establish design standards for road embankment stability <br />appropriate to the site; therefore, the following information is necessary <br />before the Division can approve this portion of the proposed operation: <br />Requirement No. 10 <br />PRIOR TO APPROVAL OF THE HAUL ROAO AND ACCESS ROAD, THE APPLICANT MUST <br />CONDUCT AND RECEIVE DIVISION APPROVAL OF A STRUCTURAL AND FOUNDATION <br />ANALYSIS TO ESTABLISH DESIGN STANDARDS FOR EMBANKMENT STABILITY <br />APPROPRIATE TO THE SITE. THE ANALYSIS SHALL BE CONDUCTED IN <br />CONFORMANCE WITH RULE 4.03.1(3)(d)(vii). <br />
