EXISTING LANGUAGE FROM THE AVLUP. DIVISION 25, SEC 106-393 <br />SEC 106-393. Uses permitted by special use permit. <br />Uses permitted by special use permit in the industrial district are sand and gravel <br />operations, asphalt plants and mosquito control facilities. The location of sand and gravel <br />type industrial properties indicated on the Animas Valley Land Use Plan Map are based <br />on the permitted areas map provided by the state division ofminerals and geology. If <br />there is any question of land use map accuracy, the records of the state division of <br />minerals and geology shall prevail. <br />Following the existing language in Section 106-393, THE PROPOSED TEXT <br />AMENDMENT WOULD ADD THE FOLLOWING LANGUAGE: <br />These permitted sand and gravel operations may be modified from time to time upon <br />application for a modified Special Use Permit and concurrent Plan Map Amendment <br />upon a finding that the modification would: <br />1. Be limited to contiguous properties ofthe current owner ofthe already <br />permitted azea and eligible for zoning change. <br />2. Result in no net gain of acres in sand and gravel mining use. <br />2. Described in a conceptual development plan submittal coincidental with <br />the Colorado Division of Minerals and Geology permit. <br />The process of fulfilling such a Special Use Permit would be: <br />1. Submittal of a conceptual development plan indicating phases ff any. <br />2. A DMG permit showing phases of operation, proposed deletions and <br />additions. <br />3. Possessing a valid permit for the sand and gravel mining activity from the <br />Colorado Division of Minerals and Geology. <br />
