NARRATIVE <br />Dillon Ranches proposes the accompanying text amendment to the Animas Valley <br />Land Use Plan related to section 106-393, a part of the land use code of La Plata County <br />specifically dealing with portions of the Animas Valley, north of Durango, Colorado. <br />The property is in the Animas Valley Planning District and is located east of Sandco, Inc, <br />between the Animas River and CR 250 in the SE '/< of Section 10 ,the SW '/a of Section <br />11, NWl/4 of Section ]4 and the NEl/4 of Section 15, all T 36 N, R9W, NMPM. <br />The text amendment addresses the concept of allowing already special use permitted <br />sand and gravel operations to be modified as to the location of their permitted acreages if <br />certain conditions are met. <br />The text amendment would require that several conditions be met to enable use of this <br />provision: <br />- properties/operations considered would be under the same ownership <br />and only acreages adjoined or contiguous to the original property <br />permitted to utilize this provision; zoning classification would <br />change through a map amendment coincidental to the Special <br />Use Permit. <br />- the resuhant operation would not show a net gain of acreage in sand <br />and gravel mining use; it would be a change in location of <br />mining permit acreage with DMG required reclamation preceding <br />new excavation. <br />- a conceptual development plan would be presented that would outline <br />the affected areas, with proposed phases of development indicated <br />coincidental to the phases of the Colorado Division of Minerals <br />and Geology (CDMG) permit. <br />The process of obtaining the modified Special Use Permit and concun•ent Plan <br />Amendment would be the submittal of an application for the Special Use Permit and Plan <br />Amendment along with a conceptual development plan (CDP) and a Colorado Division <br />of Minerals and Geology (CDMG) permit. Each phase of the CDP would mirror the <br />phases of the CDMG permit. <br />A condition of each phase of the conceptual development plan would be that a valid <br />CDMG pernut for the new location or acreage be obtained and a CDMG release of equal <br />acreage due to reclamation of a portion of the original permit area be available at the <br />same time. <br />
