The proposed text amendment needs to be applicable to more than the specific property <br />proposing the amendment. However it is appropriate to review just how a text <br />amendment might affect mining properties in the Animas Valley by using this site as an <br />example. The accompanying map illustrates the mining re-location areas on this <br />particular site. <br />The AVLUP River Corcidor District "rationale" and "purpose" has certain criteria by <br />which we can review a future Special Use Permit for this particulaz site. <br />-by a phased removal of mining from the river channel, this proposal limits <br />the intensity and proximity of development near the river. <br />-by that same action, the riparian areas (especially river edges) would benefit: <br />reduction of storm runoff, promote river bank stabilization, enhance <br />potential for flora and fauna introduction and growth on riverbanks, <br />stabilize riverbank wildlife habitat and increase vazious habitat with <br />the creation of new topography and habitat from the reclaimed mining <br />azeas. <br />-the phased relocation of mining operations would minimize the visual impact of <br />those same mining operations from Trimble Lane. <br />-this proposal does not change the residential density of the proposed new area, <br />will result in a more usable agricultural area by reason of the reclamation <br />after mirting and can enhance wildlife habitat by using wildlife friendly <br />reclamation designs and methods. <br />- the stabilization of current mining operation azeas and the development of <br />proximate, but off-river topography may aid in mitigating flood damage. <br />This particular proposal will not impact azea road capacities, does not require water and <br />sewer capability, and will have minimal visual impact as the site is buffered from pubic <br />view. In addition, it will have minimal affect on the neighborhood character due to the <br />no net gain of mining acreage and in fact eventually remove mining from the river <br />channel itself. It conforms with the goals, objectives and visions of the river corridor <br />plan by removing mining operations from the actual waterway and for the reasons stated <br />above. <br />
