<br />Section III - Status of Stipulations <br />This section summarizes the status of the various stipulations associated with <br />the Eckman Park, Mine 1, and Mine 2 permitting process. In most cases, we can <br />locate documentation regarding the tinal resolution of the stipulations. In <br />some cases, however, the record is not defiinitive. We must request your <br />assistance in supplying documents for those cases where final resolution is <br />not clear. <br />Stipulations Associated with the <br />Marc [ ermit ssued <br />to nergy ue s orporat~on <br />Eight stipulations were attached to the March 24, 1990 permit No. J9-177. <br />These are listed below: <br />1. Energy Fuels must submit the required number of corrected copies of the <br />permit application within b0 days. <br />2. Energy Fuels will review the current permit and remove all reference to <br />the use of the hydro-axe to produce a wood chip mulch. The correction <br />should take place within a period of sixty days. <br />3. Representatives from Energy Fuels Corporation, Colorado Division of <br />Wildlite, Mined Lana Reclamation Division, and Office of Surface Mining <br />will meet at the site during the spring of 1980 to discuss the impacts of <br />mining on the sage grouse lek identified in the permit. A joint <br />agreement will be arrived at to mitigate any negative impacts on the lek <br />as a result of EFC's mining activities. These mitigative measures will <br />become part of EFC's permit. <br />4. Energy Fuels Corporation must incorporate all conditions from previous <br />permits on mine 1 and 2 into permit #79-177. <br />5. Energy Fuels Ccrporation will work with the Department of the Interior to <br />resolve any remaining archaeological concerns generated by EFC's mining <br />and reclamation plan. <br />6. Energy Fuels Corporation will submit a reclamation plan for the C16284 <br />area aater the site is inspected by Mined Land Reclamation Division <br />representatives. <br />7. Energy Fuels Corporation will comply with the Division of Water Resources <br />rules and regulations. <br />8. Energy Fuels Corporation will adhere to the reclamation schedule defined <br />in the letter of March 24, 1980 from Mr. Gerald Graudy to Mr. Hamlet J. <br />Barry, III. <br />We assume that because these stipulations were not carried to the next permit <br />step, there must have been some final resolution. However, we cannot find any <br />document which verities a tinal resolution of these eight stipulations. <br />Please review your records and provide any available documents which verify <br />that the above-refierenced stipulations were definitively resolved. <br />-7- <br />
